YEU’s options are limited, president says

The president of the Yukon Employees’ Union (YEU) is not happy with the state of affairs regarding the territorial government’s COVID-19 vaccine mandate for public employees.

The president of the Yukon Employees’ Union (YEU) is not happy with the state of affairs regarding the territorial government’s COVID-19 vaccine mandate for public employees.

Steve Geick told the Star this morning there’s not a lot the YEU can do to resist the implementation of the policy while the state of emergency is in effect.

He said much the same thing in a letter to his members that was posted on social media.

“With the reinstatement of the state of emergency, the Yukon government has effectively turned an unseen employer policy into a law enforceable by CEMA officials.”

Geick said he received a notice from the government eight minutes before the start of Wedensday morning’s press conference after the cancellations of several high-level meetings with YG officials in recent weeks.

At that event, Premier Sandy Silver announced employees who decline to be vaccinated will be placed on leave without pay after Jan. 30, 2022.

“The union has not yet seen any version of a proposed policy, not even a draft,” Geick wrote in the letter.

“Today’s announcement confirming mandatory vaccine requirements comes as little surprise. We’ve seen our meetings with decision makers cancelled and our deadlines ignored as we attempt to engage in genuine consultation with the Yukon’s largest employer.

“And while we support a vaccine policy to protect workers, we stand firm that this government could have done much more to protect workers from job loss by exploring alternatives including remote work and rapid testing; it’s working in other jurisdictions and could work here.

“The best course of action for workers has always been vaccination against this virus, and we hope those whose employment is in jeopardy will consider their positions in light of the government’s announcement,” Geick added.

“We will do what we can to defend the rights of workers with legitimate medical contraindications or whose religions have theological objections to vaccinations,” Geick said.

“The reality of emerging case law indicates that there is little we or any union can do; personal choice is not a protected ground under human rights legislation.

“The employer is clear in their intention to make vaccination a term of employment both in policy and by the legal means available to them under the Civil Emergency Measures Act.”

Geick said the YEU supports vaccination as an important occupational health and safety tool.

“We will continue to explore our options as we seek to address the government’s heavy-handed, clumsy and non-consultative process, and we will update members as we move forward,” he wrote in the letter.

“We are awaiting answers to many questions around maintenance of employee benefits and pension contributions for those who will be placed on leave without pay.”

The YEU represents more than 6,000 workers, of whom 4,000 are Yukon government employees, he said.

He said no numbers are available as to how many workers the vaccine mandate could affect, but most estimates suggest 20 per cent of workers remain unvaccinated.

He said he is very concerned about the impact to small non-government organizations which will still be affected by the sweeping scale of the mandate.

Many of those NGOs operate with a skeleton staff, Geick noted, and may have to shut down if their workers are placed on unpaid leave.

He said he has seen figures on the rates of overtime to workers currently.

“I’ve never seen overtime rates this high,” Geick said.

“It won’t take much to cripple organizations ... or the government, for that matter.”

The other public sector field he is particularly worried about is health care.

If too many of those workers go on unpaid leave because they are unvaccinated, the entire system could collapse, Geick suggested.

NDP Leader Kate White told the Star this morning she favours the government’s vaccine mandate.

She said she believes vaccines are the safest form of combatting COVID-19, although she would like to see the Yukon introduce some of the other vaccine options rather than relying on Moderna or Pfizer.

That might alleviate some of the vaccine hesitancy among the population, White added.

As for public sector employees being placed on unpaid leave, White said she doesn’t know how many people that will affect – and that won’t be obvious until after the Jan. 30 deadline.

George - what a strange way to continue discussion - "you're wrong". No facts, just opinion. And with most people fully vaccinated, I very much doubt that any restaurant will go under because they lose business from the unvaccinated minority. But carry on - you clearly think you are in the right, and facts be darned.

@ Anie.. were not going round in circles, you're wrong. Workplaces have the right to implement job requirements which, inevitably will end up in shortages of staff. Yukon teachers will be the first to say NO to mandate and then at deadline see if govy sends 300 teachers home. Employers will not follow through with this mandate when they have no staff. Secondly, if a restaurant says I can't come in if I don't show the proof of vaccination, I will never go there again under that ownership. Won't be long businesses will suffer so that won't work for long. Lastly, the rights of freedom of movements are entrenched in law and it won't be long before an upper court rules the current policies as discriminatory. It's already happened in the states.

George, we can go round and round on this and never agree. The fact is there is nothing in the charter that guarantees anyone access to a restaurant, movie theatre, or an airplane. It's just not there. And I think it's safe to say that the question of whether an employer can require vaccination as a condition of employment, so long as it's not contrary to a collective agreement, has been thoroughly explored by legal experts. Like it or not, those are the realities.

@Anie.. theres a difference between vaccine as condition of employment and mandate that prevents access, travel and other freedoms to the general public because of someone choosing to take a medical procedure. That is discrimination.

George, you may be correct about it not being challenged (although it seems to me there has been a lower court case in Canada). But, all levels of government, and (before govt stepped in) many large organizations brought in mandatory vaccinations and it's reasonable to expect that they all would have sought competent legal advice first, especially large businesses.

@Anie…actually it hasn't been challenged in court yet. It will be challenged and we will know later in but for now govy is plowing forward with political wedge, distraction tactics and most of all divisive policies for their own agenda. Opportunistic. Unfortunately the govy legal defense costs are paid from endless pool of taxpayer money ( they can also spend at will under emergency act) and everyone else pays out of pocket. The truth will come out and hopefully lawsuits to follow. Like so many of us I was coerced and forced into vaccine against my will.

Well- seems like YEU is standing around with it’s thumb up there bum, again.
So we have to get vaccinated. Some member have an issue- I don’t. What I do have an issue with- is vaccine mandate is the only protection YG is offering their employees.
YEG has work to do to push for more safety for workers. Where are the safety plans to mitigate risk to their employees? Office space should be adjusted, front facing workers should be given more PPE, site planning to optimize how public accesses YG services, why are entry and exits the same door and area for front facing services. Have you been to the DMV lately- it’s a complete bottle neck with enter, exit for the public being clustered. What are they doing for their other access areas? Access to E-services?

So I guess that pesky act, HIPMA, the thing that protects our rights to keep our personal health information private, isn't a protected ground either?

Steve Geick, your decision to roll over and accept this mandate was clear from the beginning. It has been obvious you're just going through the motions because how can you fight a mandate that you agree with. Still can't believe you were voted in again.

This government's high handed and power blind mandate goes way beyond what any other province or territory has implemented. There's no other place in Canada that the government has such a stranglehold on the population, due to being the largest employer. Any other employer, organization, store, whatever, would be beaten down, shamed and cancelled for attempting to implement blanket vaccination of their employees. But it's ok for our government to do it?

Our health care system was hanging on by a thread before covid, and now, again, due to our government's continued incompetence, we're all paying the price. We don't have enough doctors or health care professionals, which is a basic duty of the government to provide. Now they want EVERYONE vaccinated to make up for their ineptitude. They've been in power for more than 5 years, and what have they done? As far as I can tell, things are worse than they've ever been.

Yes, as the progressive media joins forces with their progressive allies in academic institutions, think tanks, NGOs, and the courts, it does seem like the law is changing - at least that is the narrative.

Sadly, major unions have also bought into that narrative - probably under considerable pressure and with considerable grease being applied from every side.

Will any judge have the fortitude and strength to see through the smoke and mirrors? Or, is Apartheid Canada the new normal?

You, and your minions should be a ashamed.

Yeah, the anti vaxx NYPD union declared 10,000 would be fired/forced to quit… 34 ended up leaving. This anti vaxx crowd is constantly jumping their numbers. I was at the cenotaph on Thursday to pay respect… little did I know I’d be in a Jonas smith political rally, he declares there was 120… of there was 40 I’d be surprised. The best thing for YTG is to lose these easily swayed fools. Let them go to Alberta… our territory will only get smarter having them and their families depart.

White supports other vaccine choices because she thinks it'll alleviate hesitancy. How out of touch could you possibly be?

Our Allied health clinic is about to lose 35% of employees. Others have already said they could leave soon after because the stress will be too high. Others yet have said they'll leave if boosters are mandated.

What an absolute disaster.

Why don't you just show up to work?
When you're told that you can't be there, say, "no, i'm here for my shift."
Then they'll have to charge you or remove you from the premises.
When this happens file a charter case or human rights case.
Section 7. of the charter guarantees life, liberty, and security of person. Which includes the right to decide whether you wish to participate in a medical procedure. If you decide not to, you can not be given penalized criminally.

The problem may arise that there is not a "Direct" criminal charge from not getting vaccinated, it's indirect. But that would be up to a court to interpret. People actually have to start using the law and challenging these things or it will be accepted as the "norm" even when it's illegal.

Welcome to living under an authoritarian, autocratic state where the government controls most aspects of your life and says whatever is convenient for them at the time to both try and justify their actions and stay in power. The dictator Sandy Silver and his squad of goons took their foot off our necks just long enough to fool everyone and now it’s clamped right back on.
I never thought I’d experience what the eastern block had to put up with living behind the iron curtain but that is what life in Canada and Yukon is like today.
