Trial avoided after man changes pleas; new court date set

The trial of a man facing more than a dozen charges is not going ahead after Charles Stewart changed five of his pleas in territorial court this morning.

Crown prosecutor John Phelps consented to Stewart, 23, changing his not guilty plea to aggravated sexual assault to a plea of guilty of sexual assault with a weapon.

Stewart also withdrew his not guilty pleas. He changed them to guilty for charges of forcible confinement, theft over $5,000, the dangerous operation of a vehicle and breaching a curfew condition he was under at the time.

He also faces charges of robbery, the operation of a vehicle while disqualified, flight from police, resisting arrest, another charge of failing to comply with a condition and two counts of breaching probation.

Court documents charge that on Aug. 15, 2006, a woman's life was endangered when she was confined, sexually assaulted and had her wallet stolen while confronted by a man armed with a knife.

A minivan was also stolen and operated by a man while he was disqualified from driving.

He failed to stop when he was being chased by police and drove dangerously along the Alaska Highway, the charges read.

While being arrested, the man threw rocks and sticks, allegedly threatening to kill the RCMP's service dog, court documents continue.

The man also failed to follow both a recognizance and probation order requiring him to keep the peace and be of good behaviour as well as to comply with a curfew of between 7 p.m. and 7 a.m., the charges state.

A week in July had originally been set aside for trial.

While a statement of the facts in the case was submitted to the court this morning, it wasn't read. The file also wasn't available by press time early this afternoon.

Territorial Court Judge Karen Ruddy also granted an assessment order requested by Phelps. The Crown may make an application to have Stewart deemed a long-term or dangerous offender, Phelps said in requesting the order.

Stewart's criminal record was also submitted to the court with his next court date set for July 6 to fix a date for sentencing.
