Sisters sentenced following man’s death

Two Pelly Crossing sisters were sentenced by Yukon Supreme Court earlier this month for their parts in a homicide.

Two Pelly Crossing sisters were sentenced by Yukon Supreme Court earlier this month for their parts in a homicide.

Charabelle and Lynzee Silverfox had been charged in connection with the death of 37-year-old Derek Edwards.

He was killed Dec. 12, 2017 after what was described in court as a night of heavy drinking.

Conflicting accounts were given as to exactly what happened, but Edwards was stabbed and shot with an arrow from a bow.

The sisters were charged with first-degree murder in May 2019.

Charabelle was sentenced to life in prison after pleading guilty to second-degree murder on her part.

Lynzee received a 30-month sentence for committing an indignity to a human body.

The sentences were delivered in Pelly Crossing.

At the time of the arrests, more than a year after Edwards’ death, RCMP officers said “homicide investigations are lengthy and complex.

“The charges laid in this investigation are the result of 18 months of work by Major Crimes Unit investigators, with assistance from support units within the Yukon RCMP, as well as other RCMP divisions, including Alberta, British Columbia, and Saskatchewan,” RCMP representatives said at the time.

Charabelle will be eligible for parole in 10 years’ time.

With time already served, that eligibility period will be reduced to about seven years.

She also faces a 20-year prohibition on owning firearms.

Lynzee will serve three years’ probation.

With time served taken into account, she will now spend less than a month in jail.

The sentences were based on joint submissions from the Crown attorney and lawyers appearing for the sisters.

You are absolutely correct. This is the sort of thing that Star Reporters should be covering. Political corruption and interference in the Justice System.

Judicial Independence is a mechanism that is there to “protect the public”, not just the Judiciary. Judges must make their decisions free from “any” influence. But more importantly, they must be seen/perceived to be unbiased. This is a very high standard.

In other Jurisdictions this cohabitation between the two branches of government would be scandalous… In the Yukon the Legocracy decided it would simply suffice to block off the mezzanine access between the second floors.

There is a lot of writing on this subject and the optics of this interference in a constitutional democracy. But hey, sit down and shut up… Never you mind about democracy and stuff… Everything is political!

A fit and just sentence is fixed to the particular circumstances of the individual and their relative moral culpability for the offence. This requires consideration of the individual and societal level factors that give rise to the context of the offence.

This should in theory require a stepped approach wherein each successive violation is treated more seriously. How many times do you get to assault someone before you go to jail? How many sexual assaults do you get to rack
up before you do serious time?

You either learn or you don’t from the 1st, 2nd, or 3rd… time around, no? Perhaps it’s okay to hurt others if you have been hurt yourself? I’m a victim and so shall you be… Nice Justice system! Vengeance is yours says the cultural imperialist on the bench, vengeance is yours…

I could not agree with you more. Two lawyers at the top of the DOJ. Political interference in the PROPER administration of justice seems to be what they do best! They know all the tactics to use.
This government is BAD for Yukoners, no ifs ands or buts about it.

Which brings up another point. Why is the DOJ even in the courthouse???
Should there not be separation between the executive and judicial branches of government???
Serious question! Why is the DOJ in the same building as the courthouse? Let's make it one for the next election!

Why is it okay to have these women in the community, what do they contribute, honestly? They killed a man and they spend minimum time in jail and the man rots in the ground. The one women committed indecency to human remains, you have to be off your rocker to do that sort of stuff. This is tragic.

Our 'Catch & Release' Just-us Business wins again, while 'we the taxpayers' get to make both prosecution and defense lawyers richer. Perhaps this ongoing lack of any deterrent is why the aboriginals are abused and killed by other aboriginals.

I wonder how many people Linzee will be involved in killing before the Gladue sentences are balanced out to be on par with other killers who are not Gladue beneficiaries?

Oh yah, that’s right, Gladue is available at every step of the Criminal Justice system. Everyone in the CJS is obligated to consider First Nations people’s unique personal circumstances whether in the decision-making process to breach by a probation officer, police officer, or to proceed with a breach by the Crown and ultimately the Judge should the allegations make it that far.

It’s the law of the land. Each and every time they commit and offence whether it be criminal or administrative they get the Gladue discount.

@ POLITICO - 15 years before parole, lifelong firearm ban - freedom conditional on sobriety and 1 year of community service in Pelly and I mean 9-5 Monday to Friday. Time has been served but multiple past crimes committed. I think this would be reasonable to deter further acts of future aggression, but I am not a lawyer, juror or judge, so I only speculate. If these ladies names were Tiffany and Becka Luxenbourg, or Leona and Suzaille Mugazda, I would suggest no more or less.

Obviously, what people are asking for is accountability, assessment, rehabilitation, and a case management plan to target specific needs with a sufficiently long enough timeframe in a controlled environment for them to learn and integrate a pro social lifestyle.

The DOJ under the current administration does not assess, does not understand, and therefore cannot support real change from a holistic framework. If it were as simple as ‘culture’ they would not be killing their own now would they? Hey, wait a minute…

Time and time again I have read Gladue Reports, Presentence Reports, Bail Assessment Reports, and other supposed assessments to go WTF?!?!, scratch my head and wonder about the literacy of the report author let alone, their grasp on reality.
