Ontrario's' associate chief Justice Dennis O'Connor, who presided over the bail hearing, delivered his ruling to Yukon Supreme Court this morning via video conference from Ottawa.
At defence lawyer Gordon Coffin's request, O'Connor placed a publication ban on his reasons for turning down Karen Rodrigue's bail request.
Inside the courtroom, more than 20 people listened as O'Connor delivered his decision, with Rodrigue sitting next to Coffin with folded hands, watching Coffin take notes.
While Rodrigue showed little emotion to the decision, a few in the gallery had to wipe tears away from their faces and gasped at the news.
Rodrigue's second-degree murder conviction in the 2004 stabbing death of Gerald Dawson was overturned by the B.C./Yukon Court of Appeal earlier this year, with a new trial ordered.
After denying the bail application, O'Connor stressed the need for a new trial date to be set as soon as possible because Rodrigue will remain in custody.
A trial date will be set on Oct. 16, with the actual hearing expected for sometime in the spring of 2008.
Crown prosecutor David McWhinnie said between now and the October court date, he and Coffin will work on finding out about witness availability and other details needed to find a specific trial date.
