A Whitehorse woman will stand trial again for second-degree murder this November.

Alicia Murphy, 35, will have a retrial in Yukon Supreme Court for the death of Evangeline Billy, whose beaten body was found in the Yukon River in 2008.

Murphy was convicted by a jury in 2009 and sentenced to life in prison without the possibility of parole for 14 years.

Nearly five years into her sentence, Murphy successfully appealed in 2014, on the grounds that Crown prosecutors had introduced inadmissible evidence and engaged in “oath-helping” – bringing forward evidence solely to bolster a witness’ credibility – two key witnesses.

While Murphy’s retrial was initially scheduled tentatively for this summer, delays arose due to a unique funding dispute late last year.

Last week, the Yukon Court of Appeal upheld a ruling that the Crown must pay for Murphy’s counsel of choice, Whitehorse lawyer Jennie Cunningham.

It agreed that the Yukon Legal Services Society’s decision to not appoint Cunningham, and instead assign Murphy a B.C. lawyer, was a de facto denial of legal aid.

In cases where an accused is denied legal aid, they may seek state-funded counsel.

Last year, after her appeal, Murphy had sought legal aid as she did for her trial. She stated her preference for Cunningham, who also represented her at her appeal.

The society assigned her Outside lawyer Donald Campbell instead. Murphy appealed, again requesting Cunningham, but legal services upheld its decision, citing Campbell’s experience defending murder charges and “using common sense when resolving matters.”

The board further stated in its letter that it “is not required to provide a client with their choice of counsel,” and if Murphy didn’t want Campbell, she could pay for her own lawyer.

In November, Cunningham argued in Yukon Supreme Court that the legal aid board’s decision to offer Murphy one lawyer, and tell her to hire private counsel if she didn’t approve, equates to denying her legal aid.

Justice Leigh Gower agreed and stayed, or put aside, Murphy’s murder charge until the government funded her lawyer of choice. Murphy was released from custody, temporarily a free woman.

The Crown refused to fund Cunningham and appealed. That appeal was heard in Vancouver in April, and the three-judge panel released its decision last week.

“In these unusual circumstances, Ms. Murphy reasonably refused to accept the appointed lawyer,” wrote Justice Elizabeth Bennett.

“Ms. Murphy’s options were to accept counsel whom she understandably did not trust, or to receive no assistance from legal aid.”

Murphy had testified last year that she felt pressured to accept Campbell as her lawyer, while she felt comfortable with and trusted Cunningham. She was concerned Campbell would push her to accept a plea bargain, she said.

With the Crown now funding Murphy’s lawyer, her second-degree murder charge has been reinstated.

The trial will be held before a judge and jury from Nov. 2 to 27.

Murphy has been released on bail in the meantime.

Moe I know that, re: trial re do.

I whine about that issue because we deal with the carnage DAILY that is enabled by asinine rulings as Gladue.
I care not who the victims are ethnic wise, dead is dead and a killer is a killer.
Are you suggesting crime is not an issue if between the same ethnicity?
THAT Moe is the subject at hand, and I stuck to it.

Your right, the slack "justice" doled out DOES happen with skin pigment challenged males too.
My point...stuck to, is that when your one of Canada's royals via Gladue ruling your most assured of slack "justice" if any at all.
Stats do not cover crimes swept under the deerskin, due to the racism of lower expectations.
Which is PRECISELY what Gladue is, racism of lower expectations.
Yet when one speaks of the "Moose in the Room" (Google that), they themselves are vilified as whatever vitriol is deemed cool by bias moderation.

Still waiting for the "specific" CCC section that enables the "white male" to get a good stern talking too, or nagged by the elders of his white community, where the white culture clubs are etc.
As I can reference every point I make and do...when it is not "tossed" by moderation.

Josey, ridiculously inadequate sentencing also applies at times to white males. I simply took one example from memory. I could also cite the 10 year sentence of Kieran Daunt who shot and killed Robert Trusswell in Dawson, who repeatedly threatened to kill him, and who had previously hit someone in the head with a piece of wood causing permanent brain damage, and who lots of other people in Dawson testified was a menace, as an example of a total miscarriage of justice in the opposite direction.

My point is that your constant whining about the inadequate sentencing of 'FN' citizens and women, is selective reporting of the situation. So far as this case goes, Alicia Murphy is appealing based on 'inadmissable evidence', NOT Gladue sentencing rules.

And may I point out to you that the victim of this murder is also a First Nations woman.
So stick to the subject at hand. You are ranting like some kind of broken record.

Josey, grow up. Google Ralph Klassen if you want to see an outrageous miscarriage of justice. I don't think he spent even 5 years locked up for strangling his ex wife Susan to death, after stalking her around the country, then tying a pillow case tightly around her neck just to make sure she would not somehow survive, then attempting to kill himself by driving headon into a propane truck, almost killing the driver of that truck.

There's a 'gender based, race based' law for you. A white man who got away with murder by saying a woman made him do it by insulting his manhood.

However that building on 2nd ave full of gibberish?
They could give a rats ass about those left in the wake of criminal scum, faaaaaar more concerned with the folks who create the carnage.
That message has been loud and proud since 1982, from our legal system....
there is little justice going on in that building.

We are all here for them to use as practice dummies for stabbing, shooting, beating, robbing and raping proficiency...to hone if you will "their" craft.
I speak of both criminal scum and fools who advocate for them...

I've been bleating for years...nah decades, that we are "on our own" out here.
Race based laws...
Gender based laws...
Bushings turned to grinding dust on our "turnstiles" of laughable "justice"....

rhetorical...I know folks loathe my POV, at least many..but clearly not all.
Been in a race to the bottom since 1982 we have, regular readers/haters of Josey know exactly the reference.
Of course my mere "opinion" June, when permitted to have one here.
June on that note I'd like to acknowledge publicly that the epic "edits" I am subject to here at the Star...are becoming far less frequent.
Almost like a media, is also recognizing the nature "Freedom of Expression" as being a valid right...despite the uncomfortable nature that comes with speaking of the Elephant in the room.
June thanks for defending that right in relation to my POV here and vilification of said POV.

Our justice system..or lack thereof.. is just so screwy. However..it could be really good for me if I ever decide to kill someone.
