Pizzeria serves up a formal apology to job applicant

The owner of a local pizza joint has formally apologized for discriminating against a female job applicant because of her gender.

By Rhiannon Russell on February 5, 2015

The owner of a local pizza joint has formally apologized for discriminating against a female job applicant because of her gender.

“Unfortunately, we made a mistake when we decided not to consider your résumé because of your sex,” Kathleen Lundgaard, the owner of Tony’s Pizza, said in a written apology to Georgina Dawson.

“It was not our intention to offend you or anyone. We want to make this right, and to restore our relationship with you and with the community.”

Last November, Lundgaard posted on the restaurant’s Facebook page that she was looking to hire a pizza chef.

When Dawson commented that she’d applied “a long time ago,” Lundgaard replied: “I would prefer to have a male in the kitchen, less distraction for the other male employees.”

That response was greeted by social media furor and threats of a Tony’s Pizza boycott.

Dawson filed a complaint with the Yukon Human Rights Commission.

“I pursued the complaint because I felt strongly that it is our responsibility as community members to speak up when discrimination happens,” Dawson said in a statement. “For my daughter and all women, I had to speak up.”

Commission director Jessica Thompson said both parties were willing to work together to come to a resolution.

The goal is not to punish or reward either side, but rather to help make the complainant “whole” again.

“Ms. Lundgaard and Ms. Dawson both engaged in the human rights process in good faith and openness,” Thompson said.

“The commission does a lot of quiet good work in the community like this. This matter happened to have already been out in the public eye on social media and, as a result, both parties felt it was appropriate to share with the community the positive way that it ended.”

Tony’s Pizza will continue to work with the human rights body to improve its employment policies.

Thompson said the commission is willing to offer information and free assistance to any Yukon employer in learning more about fair practices in the workplace. “We are here to help,” she said.

Sometimes I have to remind myself that this is actually 2015. The employer was wrong & the men working at this place were wrong. It is never acceptable to discriminate against anybody. Because it happens does not make it right and I applaud Ms Dawson for filing a complaint with the Human Rights Commission. If more people did this we would in fact have less discrimination which is a good thing for all of us.

Can an employer try to discriminate, yes but they also can be held accountable for that discrimination. This has nothing to do with honesty at all.

For those that think the only thing the employer did that was wrong was advertise their personal beliefs I have to wonder whether your parents ever took the time to teach you the difference between right & wrong. We must have higher expectations for ourselves and others to be a healthy society.

The question I am now left with: why would the employer choose to keep staff that would be distracted by, or bother other workers, female or otherwise? I would NOT tolerate it. Boys will be boys? Sure, on their own time, not in the workplace.....

While it's obvious that private business employers can hire who they want, discriminate as they please, or whatever, that doesn't make it RIGHT.

Yup, this employer made a boo boo and got caught and I'll guess she'll know better next time than to speak her mind honestly... but I'm still wondering, woman to woman, why employ people who you think won't work maturely with other staff? Hire the BEST team who can do the job without being "distracted" by others or whatever.

I find it disturbing the comments who think this is acceptable. Yup, it can't be stopped, but it's not ok.

A few years ago the Ontario Govt had such a blatant hiring policy in favor of minorities, visible or otherwise, that they might as well have just finished the job position as advertised with 'Caucasians Need Not Apply'. T'was ever thus.

Employers should be allowed to hire who ever they choose, hire as many TFW"s as they want.

Just a reminder to those saying Tony's Pizza had one fault, and one fault only, that being that they were 'Too honest.'
In following the case back a few months ago, it came out that former kitchen employees, females, had taken issue with being sexually harassed by the men they worked with. Rather than dealing with that very big problem, Tony's Pizza's solution was... To not hire women! Ya! That's the ticket!

No. You inform the men that their harassment is actually not even legal, let alone okay. Well maybe it's legal for the kitchen workers to say whatever they want but it is not in fact legal for a business owner to fail to provide a work place free of harassment.
If Tony's Pizza was not willing or unable to change the behaviour of their male kitchen staff, those staff should have been fired. You do not tell women they cannot work there because the male employees cannot and will not control themselves.

Anyway, it's all for the better. A woman stood up and fought for her rights, an employer had to re-think 'convenience', and the public had an opportunity to see what blatant sexism looks like and to see that it does in fact still exist today.

Why does Yukon Human Rights let the Government discriminate against employees?

The business owner was open to applicants and should hire who they want to hire. I don't see anything wrong with this. I still eat there and the food is great.

Society today is rife with double standards..every day there are adverts advising this job for First Nation only, or visible minority..or French speaking applicant only...yet this same society will hang you if someone put an ad out saying..white English speaker only need apply..

It is my opinion that all jobs should go to the most qualified applicant..employment selection should be blind..getting work should not be dependant on your color, religion, beliefs, or anything but ability. I believe that employers should have the freedom to set job qualifications applicable to the position..I.e. A grade school doesn't want to hire a pedophile teacher..a restaurant might want to hire someone that can lift 50 lb bags of flour.
While North of 60 and mantis have valid points regarding private industry I think in the long run everyone benefits that hires a person who is best qualified for the job. I know a lot of people in government who have their job because of a friend or family and totally unsuited and unable to perform that job competently..as usual..I speak only for myself..

It should be known that a business is always biased when it hires. It makes a decision based on who they think will be the best asset for their business even Government does the same. I call out to the public to support this business to offset any boycott.

This was not "gender", it was straight up SEXism. But I'll agree that expressing one's sexism right up front is not very bright.

You are right they can choose who to hire or not. However they cannot discriminate against people when considering them for employment!

This is a valuable lesson for any employer. Hire anyone you want for whatever reason, just don't mention gender or race. Honesty isn't always the best policy.

Employers can discriminate for whatever reason they choose. Now they will know they can't mention gender, race, or or any other politically incorrect reason.

Employers will hire those people they feel are best qualified to work compatibly with the existing staff. They don't have to justify why. This employer's only mistake was being too honest.

It's their business, they should be allowed to hire or turn away whoever they want and not apologize for it.
