Pair sentenced for impaired driving, breach of probation

Two Whitehorse residents were sentenced for alcohol-related offences in court Wednesday.

Two Whitehorse residents were sentenced for alcohol-related offences in court Wednesday.

Denise Boss, 30, received a $1,000 fine plus a $150 victim surcharge for impaired driving. She had pleaded guilty to the charge.

At 10 p.m. on Oct. 31, 2007, the RCMP Whitehorse detachment received an anonymous complaint that Boss had left a local bar in a truck while 'heavily intoxicated,' Crown counsel Mike Cozens told the courtroom.

Police officers went to Boss's residence and found that her blood alcohol level was .22, well above the legal limit of .08.

Defence lawyer Gord Coffin said Boss 'fell off the wagon' that night.

He said his client has attended Alcoholics Anonymous meetings and been in touch with staff of the territorial alcohol and drug services branch.

She prefers a 'sober life,' added Coffin.

Justice of the Peace Dean Cameron also imposed a one-year driving suspension on the woman.

Meanwhile, John Silas, 24, was given credit for the 26 days he has already been in custody by breaching his probation order on Dec. 21.

Silas was serving probation for two assault convictions when RCMP officers received a complaint from a Whitehorse resident that Silas would not leave the premises.

Officers found that Silas was intoxicated. Silas also identified himself as 'David' Silas to the officers at the scene.

Crown counsel said Silas's criminal record is of 'some concern' because it shows a history of a failure to comply with probation and violent offences related to alcohol consumption.

This case was also determined to be an incidence of 'falling off the wagon,' and Cameron did not impose a custodial sentence beyond what Silas has already served.

Silas said he plans to complete a 28-day addiction treatment program next month.
