DEFENCE SUBMITTED – Martin Lehner, director of Orange Technology, denied statements he made about Northwestel were defamatory in a statement of defence filed in Yukon Supreme Court.

Orange Technology files its defence statement against suit

A local company sued for defamation by Northwestel Inc. has filed its statement of defence in Yukon Supreme Court.

A local company sued for defamation by Northwestel Inc. has filed its statement of defence in Yukon Supreme Court.

Orange Technology denies that the statements its director, Martin Lehner, made in the media about Northwestel’s Internet service were defamatory.

On Nov. 20, 2015, Lehner appeared on the CBC Yukon morning show, A New Day.

He was being interviewed about the Yukon government’s plan to build a fibre line along the Dempster Highway.

He told CBC the new line would offer redundancy, but wouldn’t fix all of the territory’s Internet problems.

Northwestel took issue with part of the interview.

In it, Lehner alleged one of his client’s Internet service goes out frequently, that the issue comes from Northwestel’s infrastructure and that the company had told them it didn’t plan to fix it.

On Jan. 14, the company filed a lawsuit.

“The statement is defamatory ... in that it discredits Northwestel by suggesting that it is unresponsive to complaints by its clients,” the company said in its statement of claim.

In the statement of defence filed Feb. 10, Lehner and Orange Technology advance three distinct defences to argue the statements weren’t defamatory.

The first is that the statements refer solely to Northwestel’s goods and services.

The second is that those statements are true.

The company also denies Northwestel’s claim that the statements imply that the company is unresponsive to complaints made by its clients.

But even if the court were to rule the statements do imply that, these innuendos are still not defamatory, the company argues, because they fall under the defence of fair comment.

In a 2003 case involving the Winnipeg Sun, the court of Queen’s bench of Manitoba looked at the defence of fair comment raised by the newspaper.

“Everyone has a right to comment on matters of public interest provided he does so fairly and honestly and such comment, however severe, is not actionable,” the decision read.

The judge in that case set out the criteria to establish such a defence.

The statement in question must be a comment, not a statement of fact, it must be fair and it must be on a matter of public interest.

“In the alternative, the Alleged Innuendos (...) are fair comments made in good faith and without malice upon a matter of public interest involving the state of Internet services in the Yukon Territory and the effect the development of a second fibre line will have on those services,” the statement of defence reads.

Orange Technology also denied it had an “improper motive” for making the statements Northwestel took issue with.

Orange Technology and Northwestel declined to comment for this story.

ATIP NWTWEL complaints dept. I live on Juniper in Porter Creek and myself, my neighbors and Tamarack, Evergreen all have horrible service due to crap drop line. NWTEL hardware is dated and crap, yet we all still are billed full pop for internet that is inconsistent, channels don't always work yet again we are billed full price. I have been asking for a fee for service, discount or upgrade as per the monthly bill I pay. NWTEL tecs say yup it is our hardware, trouble line says yup it is our hardware, but I still pay 100% fee for less than 70% service.

I feel that Northwestel has abused the consumer with enormous fee's and offering poor service in return. (Sue me.) Having said that, my feeling that Martin should win has little to do with what was said, and a lot to do with Northwestel getting some comeuppance for years of ticking off the general populace.

Its kind of petty, but, even if Northwestel is right... I still hope they lose.

Northwestel - Your prices are gouging Northerners every single day and acting as a monopoly. Are you going to sue me now for making those comments!? You aren't doing yourselves any favors by picking on the small businesses in town just because you don't like what they had to say about you. Sometimes the truth hurts. Accept it.

Much as I am loathe to defend Lehner, did anyone notice NWTel didn't name CBC? T How could this comment even come close to causing even a dollar's lost revenue to NWTel? Just the cost of providing the financial documentation they would need to to prove damages would be a 100 times what they could possibly expect to get out of him.

Good for Martin and Orange Technology although it's going to take money and effort to defend themselves. I still can't figure out why on earth Nwtel decided to launch this lawsuit, as it opens up a big can of worms. My money is on Orange Technology to come out of this.

His comments were specifically about Nwtel and you cannot consider the entity and the services separate.

"“This is not a problem of the fibre-optic line going south,” he said, according to Northwestel’s statement. “It is a problem with the last mile of delivery - the pair of wires that goes from their office to Northwestel’s office.”

He also said other clients in the McRae area have outages “every single day.”

“They’ve been told by Northwestel that there’s an issue with some of the infrastructure that delivers Internet in that area and there’s no plans to fix it at all….”

It also says Lehner’s statement exposes Northwestel to contempt and ridicule, damages its business and exposes it to possible sanctions from the CRTC, Canada’s telecommunications regulator.

His comments were brash.

NWTel have very deep pockets given their monopoly status in the Yukon and even if they lose they hope to disrupt Orange Technology.

This should be interesting. I imagine NWTEL didn't really want to go to court, but to put a scare in him. Then he said OK lets go. Good for you.
