Offender had tried to flee RCMP officers

A convicted sex offender deemed a long-term offender by the courts will head back to jail for breaking the terms of his release.

A convicted sex offender deemed a long-term offender by the courts will head back to jail for breaking the terms of his release.

In territorial court this morning, Judge John Faulkner sentenced John Walter Sam to a total of 27 months for escape and being at large and for breaching a long-term supervision order.

The breach earned him the two-year sentence, with an extra three months to be served for the escape.

At a two-to-one credit time for the 7 1/2 months spent in custody leading up to the sentencing, Sam will have one more year to serve in the sentence.

The sentence means Sam will be taken away from programming available for him in Whitehorse, Faulkner acknowledged. The judge went on to state he is not convinced Sam is fully engaged in the rehabilitative effort.

Charges of taking a vehicle without consent, resisting arrest and another charge of breaching his supervision order were stayed.

Under conditions imposed by the National Parole Board when he was released, Sam had to reside at a community residential facility.

He also had to abide by curfews imposed, abstain from the use of drugs and alcohol and have no contact with children or youth under the age of 18 unless supervised by an adult approved by his probation officer.

The offender, about 41 years old, was also required to take whatever counselling was ordered and to participate in a community sex offender program.

The charges date back to last July 23.

Whitehorse RCMP were called about a vehicle parked in wooded area near Range Road and Mountainview Drive. When they reached the scene, they found Sam in the car. He already had an outstanding warrant at the time.

As he was being arrested, Sam ran into the woods, with officers chasing after him. After a brief struggle, Sam was arrested and taken into custody.

Sam moved back to Whitehorse in February 2005 after serving his 3 1/2-year sentence for sexually touching a young female relative when he was in Whitehorse in 2002. At that time, he said he would not return to Whitehorse.

Sam has also served sentences for other sexual crimes before he arrived in Whitehorse in 2002.
