Minister accused of contravening territorial act

The Yukon Party is claiming that Education Minister Jeanie McLean contravened the Child and Youth Advocate Act.

The Yukon Party is claiming that Education Minister Jeanie McLean contravened the Child and Youth Advocate Act.

The accusation arises from Child and Youth Advocate Annette King’s report on the Hidden Valley Elementary School sex abuse scandal tabled in the legislature Oct. 12.

In the report, it is stated that “In refusing to co-operate with the review, the Department of Education was in contravention of the Child and Youth Advocate Act.”

In a press release, the YP cited a Star story published Aug. 6, 2021.

In it, McLean said the Child and Youth Advocate had no authority to investigate how her government handled the crisis at the school involving former educational assistant William Auclair-Bellemare.

He pleaded guilty to sexual interference involving a child at the school in 2020, and subsequently served a jail term. The government chose not to inform school community parents of these events.

The YP notes the article quotes the minister as saying: “…it is the view of the Government of Yukon that the Child and Youth Advocate office does not have the legal authority to conduct the kind of review that has been proposed.”

“On top of finding the Liberal government has continued to fail children, the CYAO report found the minister contravened the act,” said YP justice critic Brad Cathers.

“The minister needs to explain why she contravened the Child and Youth Advocate Act and apologize to the Child and Youth Advocate for trying to deny her the ability to use her lawful authority to launch an investigation.”

Cathers raised the matter in question period Monday, asking, “Is the minister aware that her initial response to the Child and Youth Advocate was in fact a contravention of the Child and Youth Advocate Act?”

McLean responded by saying, among other things, that “We absolutely worked with the Child Advocate and provided her with all of the information that she required to do her report.”

Cathers tried again.

“Mr. Speaker, I have to remind the minister: the advocate’s report tabled last week specifically singled out the minister for her comments in the Whitehorse Star in August last year.

“The advocate’s report says — and I quote: ‘… the authority of the Advocate was publicly brought into question by the minister of Education.’

“So, the Advocate is very clearly singling out the minister’s comments here. The Advocate then went on in her report to clearly say that this is a contravention of the act,” Cathers noted.

“What is the minister’s response to the report stating that she contravened the Child and Youth Advocate Act?”

McLean again responded from her speaking notes.

“We’re working closely with the Child and Youth Advocate on other reviews such as the Jack Hulland Elementary systemic review, and we’ll continue to work closely with her,” the minister advised the house.

Cathers tried a slightly different tactic – with similar results.

“Mr. Speaker, unfortunately, the minister’s initial response to the Child and Youth Advocate’s notification letter had a negative impact on families affected,” he said. Here is what the Advocate’s report says: Education ‘… stated they were not in support of the Advocate’s review advancing as presented.’

“Education ‘… did not respond to the concerns addressed in the Advocate’s notification, further enraging parents and community members.’

“The fact is that the minister and her department’s initial response to the Child and Youth Advocate’s review contributed to the anger and mistrust between the school community and this Liberal government,” Cathers said.

“Once again, Mr. Speaker, will this minister apologize for contravening the act?”

McLean fired back at the Yukon Party: “I do have a question for the member opposite about their handling of these matters in 2015. I think that they owe Yukoners an answer in response to the way that they dealt with the first allegations against this individual.”

The Yukon Party held government in 2015.

Opposition Leader Currie Dixon didn’t respond to McLean’s query. Instead, he continued to grill her, asserting that McLean did not have children’s best interests in mind during the crisis.

“Last week, the Child and Youth Advocate’s report that was tabled in the legislature made one thing very clear: not only were children not prioritized, but their rights were violated,” Dixon said.

“The report found that the Liberal government’s ‘incredibly poor handling of the situation’ caused harm. Despite this, last week, the minister repeatedly told the legislature that the well-being of children was at the heart of the government’s response.”

Dixon wanted to know: “How does the minister explain this extreme discrepancy between what she has told the legislature and the Child and Youth Advocate’s report that she herself tabled last week?”

McLean responded, “I have stated many, many times — and I will continue to say — that at the heart of this issue are our children and their well-being, safety, and protection.

“We at the Department of Education, when children are in our care, take this very seriously. We are focused on taking the needed steps to rebuild the trust and provide the best targeted supports to the school community.”

Following Question Period, Dixon told reporters, “This is something that we had raised last year and had asked questions about and in response to reporting in the Whitehorse Star, where the minister had indicated … that she felt the government of Yukon’s position was that the Child Youth Advocate did not have the legal authority to conduct the review. This was an early attempt by the government to stymie the Child Youth Advocate’s work.”

Eventually, Dixon noted, “they came around and agreed to work with the Child Youth Advocate’s report or Child Youth Advocate’s office. However, I found it remarkable that the Child Youth Advocate’s report noted that those actions and those comments by the minister were in direct contravention of the act.”

Josie as to the investigation into wrongdoing around the YG group homes fiasco the reporter might want to do a write up on the person who was the public face about the whole group home fiasco and who also spoke untruths about the situation ended up getting promoted up to Director. Staff with legitimate concerns were disciplined, fired and not supported in general. Curious and more curious.

@YukonMax That new party already exists, it was recently formed and is called the "Yukon Freedom Party". I believe Joseph Zelezny and Jonas Smith are running it.

Hopefully they will win at least a few seats in the next election.

I support what you have laid out. Drawing the comparison between the two reports is well thought through. One other person noted you did not mention the other reports. For the purpose of your comments it was not necessary.

I have to agree that for there to be accountability we will have to wait for an election. I simply do not see anything of substance happening before that. What is more disturbing is the children have been used as pawns by the department and the political arm in an attempt to put a lid on what occurred. The victims are just that - victims, forgotten and shunted aside to be forgotten. I find that disgusting. All to cover one's ass and point the finger in other directions or hide behind disinformation.

I too thank the Advocate for her observations and recommendations. Do I hold hope that we can move forward. Yes, once we have a cleansing of those involved. When that happens it will send the strongest of messages to everyone that this kind of behaviour will not be tolerated, regardless of who you are.

The Yukon doesn't need a new government as much as it needs a new party with a platform that addresses the Yukoners actual current needs and aspirations. A party that can put the taxpayers before the party. A party that can leave the Old Boys and Girls of our political spectrum bite the dust.

@Barb. Yes McLean should apologize. But so should McPhee, Cathers and Dixon. Basically all of the politicians in charge since the beginning of this horrible child abuse saga back in 2014 or 2015 up until now.

None of this should surprise us but is anyone one else comparing this response to the youth in care of YG getting locked out by YG? It appears this issue matters more due to the class of children involved. Where is that wrongdoing report we were promised at anyway? Does the government actually ever hold anyone accountable for abuse of children? Shame on you YG and all you staff who have gone along to get along!

McLean probably did contravene the Act by refusing to cooperate and provide information. The Liberals, country wide are notorious for hiding information, throwing up diversions and smoke screens, and out and out lying. Follow the Feds..no different here.

Sorry but there will be no healing or accountability if the Yukon Party wins, and they are the ones leading in the polls right now. Only the NDP has no responsibility to bear in this. Currie Dixon, Brad Cathers, Scott Kent, Stacy Hazzard, Wade Istchenko and Patti Mcleod were all part of the government that first let this happen back in 2015. If the perpetrator would have been tossed out when they first caught him, no kids in the future would have been hurt. But just like the current government, the people in their departments covered it up. As a result, the abuse kept happening right into when the Liberals took power.

Also, you mention 2 different reports but there were actually like 4 or 5 including one from the RCMP. I suggest you read them all if you are truly interested in what happened.

It is difficult to imagine how anyone can be so blatant about denying what is on the record they have said. McLean's assertions that she respects the role of the Advocate holds no water, simply because her actions speak otherwise.

I think, for me, what is most disturbing is that she has a bit of that Trump quality - deniability. There are parallels between these two people that exhibit this behaviour. The old saying that "you can change the spots on a leopard, but you can not change the fact it is a leopard" rings true with this minister. It is quite apparent by her very first assertions - just last year, that she believes that the Advocate is nothing more than a pain in the butt, wanting nothing more than to wish her away.

Having read the independent report that the Advocate provided is worth it's weight in gold. The one "commissioned" by the department was more soft and fuzzy and did not cast the net in a manner to capture those that should be held accountable. One analysis was done at minimal cost while the other cost tens of thousands of dollars. One was independent while the "paid" one provided the department an opportunity to offer "clarification" to the final document. You decide which you are able to believe. Me, the choice was, and is, obvious.

Both McPhee and McLean have, and are, dishonest in their responses to what happened in attempting to keep the cover on what occurred. The result being, for me, a total and absolute lack of confidence in the actors who were involved from the department right on up to the Premier office and all those in-between.

It appears that the only accountability that is likely to happen is an election - where-upon this gang will be humiliated at the polls and a new government will have the opportunity to begin the healing process by all those affected. First on the agenda will be to clean out the bacteria at the highest levels of the department as the first order of business by the new premier.

She got defensive and rattled but in the end could not come up with a good excuse (because she doesn't have one)

Shame on the Yukon Liberals for trying to block this advocate from doing their job - a job that the Liberals failed to do themselves.

Meh. They aren’t holding the kids to any standard anymore. They aren’t allowed to fail. Social promotion and all that. So why expect the adults to be responsible? No one should be held accountable. Of course not. Too many hurt feelings. Might be discomforting. The Yukon’s governance is in the hands of serious and competent people. I am reassured.

It’s too bad the kids are caught in this mess of politics. Can’t both sides see through all the BS and support the families involved? Constant blame game back and forth accomplishing nothing.

All of these elitists politicians in their fancy suits and clothes don’t care about you, they are there for their own salaries and pensions, and this is only one example.

Are we surprised? No. We have been witnessing a complete lack of accountability both here in the Yukon and on the national political stage. We can all recall times in the not too distant past where Ministers were forced to resign over what I think today would be considered trivial compared to what is now acceptable behaviour for Ministers of Education, Health and even Prime Minister if we are truly honest.
The better question is - why do we even have laws in place for our political leaders if no one holds them accountable? Not advocating for ANY changes to our legal or democratic systems - but we as taxpayers and voters need to remember this 'little lapses' next time we go to the ballot box. Minister McLean - we expect better, we demand better, instead of throwing jabs across the floor of the legislature - show some leadership and own your mistakes and errors.
