Man stands accused of drugging, raping woman

Billy Field, 38, is charged with drugging and raping a Whitehorse woman in October 2008.
Crown prosecutor Jennifer Grandy addressed the jury this morning and outlined the case against Field.
Four witnesses will be called, she said, including the alleged victim and her 11-year-old daughter.
First to take the stand this morning was RCMP Const. Christopher Terleski. He was called to Whitehorse General Hospital on the afternoon of Oct. 26, 2008 because a woman had come in saying she had been raped.
He described her demeanour as "shaken. She wouldn't really look at me. She was nervous. I'd describe her as emotionally distraught.”
Terleski took a videotaped statement from the woman, which was later lost, although a summary of her statement was not.
The woman said she had invited Field over that evening and he had brought with him two bottles of wine.
The pair sat down and each poured a glass, the woman adding an ice cube to hers to cool down the drink, court was told.
She then went to the washroom and when she returned, she noticed bubbles in the wine, Terleski said.
The woman assumed they were caused by the ice, and when she sipped the wine, it tasted bitter. That was the last thing she remembered before morning, according to Terleski.
She awoke at 8:00 the next morning, lying on the floor with Field beside her, she told the officer.
According to Terleski's notes taken from the statement, she asked Field what had happened and he told her she had consumed a bottle and a half of wine and the two had had sex several times. He began initiating sex again, she told Terleski, but her daughter walked into the room and he stopped.
The woman also told Terleski she didn't understand why Field had drugged her, because she would have willingly had sex with him that night.
Under cross-examination, Terleski admitted there were a number of oversights and oddities in the investigation, in addition to the lost video statement.
When he went to the woman's house to gather evidence, she brought him the bottles and the two wine glasses, one of which was broken and both of which had residue in them.
Terleski did not take any photos of the scene, nor did he enter the house beyond the front doorway, he said.
The next day, the woman dropped off a pair of men's underpants, a pair of woman's and a brown bag with a receipt from the 202 off-sales in it.
Terleski conceded it was not common procedure for police to have evidence dropped off at the detachment rather than gathering it themselves.
The jury then heard that only portions of the physical evidence were actually tested at the RCMP's crime lab, a process which took until March 2009. Only one wine glass was tested for potential date-rape drugs, and neither of the wine bottles.
"I didn't see it as suspicious,” Terleski said when asked why the second glass wasn't sent to the lab. One glass had a crystaline substance in it, while the other only contained typical wine residue, he said.
The officer was also questioned about an email from his detachment commander, sent in mid-March, which said there was political and public pressure to resolve the still-open case.
The complainant was scheduled to give her evidence later today, followed by her daughter.
Court is also expected to hear from an expert witness who will give his opinion about the sleeping pill Zopiclone, traces of which were found in the woman's blood and in the glass.
The defence has not indicated whether Field will take the stand.
