The sentencing hearing of a 32-year-old Pelly Crossing man has been pushed back a day due to his lawyer’s unavailability.
Tristian Joe had been set to appear in court for a sentencing hearing for manslaughter on Aug. 21, 22 and 23 in Pelly Crossing.
Joe was originally facing a second-degree murder charge, but through a plea bargain, he pleaded guilty to manslaughter. The charge stems from the Nov. 4. 2016 death of Raine Andrew Silas, 18.
Jennifer Cunningham, Joe’s lawyer, said Thursday she is no longer available on Aug. 21.
She asked Justice of the Peace Christine Regehr-Panter to begin on Aug. 22.
Crown prosecutor Jennifer Grandy did not object to the change, and Regehr-Panter set the date. Joe will remain in custody until the hearing.
According to the agreed statement of facts, Joe struck Silas on his left temple with a piece of lumber during the evening of Nov. 3, 2016 after an argument had broken out between the two, who had been drinking together.
Silas was rushed to the Pelly Crossing Health Centre for medical attention.
He died at 11:30 the next morning at his grandparents’ home. The coroner ruled that Silas had succumbed to a head injury caused by blunt force trauma.
Joe gave a police statement after Silas died, and was arrested Nov. 14, 2016.

They were drinking and it was likely not intended to seriously hurt the victim. Maybe a get out of jail card could be used and a sentence of community service used to settle this.

Hmmmm, not trolling folks but serious question....nnnnKay?
Assuming contact never happened, what might have been the solution for this outcome say 3...5...7 thousand years back?
I often am preached to about those glory days, and cannot make it a day without such a reflection it seems.
But yet crickets on this topic?
Seems everything else traditionally speaking jives as of late?
Why not the traditional solution as it would have been?
Speaking from ignorance, I doubt highly that it would involve getting nagged in the center of a circle of scary chairs.
That said, enlighten me of my ignorance as I truly am curious...please?

Incidents like this bring disrepute on the court and give people the impression that it's just a big club. Why can't they get it right rather than wasting taxpayers money going on and on and on!
