As a result, the Dawson City man remains in custody at the Whitehorse Correctional Centre.
McDiarmid, 36, is expected to stand trial in January before a judge and jury in Yukon Supreme Court.
He faces seven charges: assaulting a court-appointed lawyer, uttering threats, assaulting a peace officer, resisting a peace officer, two counts of intimidating a justice system participant and attempting to obstruct the course of justice.
The incident is alleged to have happened in February 2014.
On Wednesday, Justice M.D. Gates granted McDiarmid’s release on a recognizance with no sureties. The details of the bail hearing are protected by a publication ban.
The recognizance has nine conditions, including that McDiarmid must report to a bail supervisor within 24 hours upon his release, remain within the Yukon, seek and maintain employment, keep the peace and be of good behaviour.
McDiarmid has been in custody at the Whitehorse jail since October 2011, when he was arrested following an incident in Dawson.
He was convicted by a jury in March of three counts of assaulting RCMP officers with a weapon, mischief and possession of a weapon for a dangerous purpose.
Last month, McDiarmid was sentenced to 40 months in jail for these offences.
He’d already served the time in pre-sentence custody.
His trial is scheduled to begin Jan. 4, 2016, in Whitehorse.

Imagine a place where you can always meet a con on parole and 'poof' you're in the Yukon! One condition should have been he not be allowed to interact with the public.....but these things can sort themselves out.
