Man accused of sexual assault held in solitary confinement

The man accused of accosting a young girl in a Canada Games Centre change room last Thursday is being kept in solitary confinement at the Whitehorse Correctional Centre because there is nowhere else for him to go.

Meanwhile, the Department of Health and Social Services is looking into how the man – who is in government care – came to be alone with the child in the change room.

William Everett, 30, was arrested Thursday after a Grade 4 student on a skating field trip told a teacher she had been approached by a man in the unisex change room.

The man allegedly said he was a Games Centre employee and tried to touch the girl in an inappropriate way.

Shortly after the arrest, Justice of the Peace Dean Cameron ordered that Everett be kept out of general population, in a "hospital cell”, while in jail.

His segregation is likely due to an intellectual disability.

Everett lives in an adult group home, run by a private contractor but mandated by the government, and is supposed to have one-on-one supervision at all times when out of the house.

According to Health and Social Services spokeswoman Pat Living, the department will be meeting with the employees from the home to discuss how or why Everett was left on his own, and how the situation can be prevented from recurring.

"We have to really clearly look out for everyone's safety: members of the public and people in our care,” Living told the Star this morning.

Everitt appeared in court Monday, wearing a jail-issue orange jumper, and sat silently through the proceedings.

Very little came out of the well-attended bail hearing, as the on-duty public defender said Everett couldn't give him instructions on applying for release, nor could he consent to staying behind bars until trial or sentencing.

The lawyer did not provide any details on why Everett couldn't advise his legal counsel.

Generally, people accused of nonviolent sexual touching are released on bail.

The lawyer did note that Everett can't return to his group home, so the isolation cell at the jail is the only place for him.

Cameron said the way things are going, Everett will have to appear before the court every three days until a solution can be found, "which wouldn't be good for anyone,” he said.

Court documents state Everett is charged with sexual assault because he allegedly touched the girl "with a part of his body, to wit: his nose.”

That rather strange detail was not explained in court Monday.

In February 2009, the Yukon Review Board declared Everett unfit to stand trial for a 2008 offence, the details of which are not public.

Yesterday, Cameron ordered a psychological assessment to determine if Everett is fit to stand trial for the Games Centre charge.

Following the arrest, police spokesman Sgt. Don Rogers told the Star it is very rare for a child to be approached inappropriately at the Games Centre.

The incident was raised in the legislature Monday, with Liberal Leader Arthur Mitchell asking what, if anything, the government is doing to address the "breakdown” which resulted in the man being in the change room unsupervised.

"We are undertaking an internal investigation of the situation,” Health and Social Services Minister Glenn Hart replied.

"We will make no comments until such time as the results of this investigation are known and until such time as the court situation has been discussed.

"Then we will look at what has to be done to ensure the safety of not only the children at the Canada Games Centre, but individuals in our care.”

Don. Try to gather at least a few shreds of information before making a comment.

This occurred during school hours on a scheduled skating trip to the CGC. The change room in question was one of the hockey dressing rooms. The classes were skating and she had to use the bathroom. The school struggles to get parent volunteers to help out (imagine 50 plus kids, 3 teachers) to come out, maybe you could volunteer?

I think most alarming was that the school kids and Everett were allowed to be in the same building given his track record. Obviously a mechanism needs to be in place where these two users groups NEVER cross paths.

Talk about arrogance don. How do you know she was left alone? Maybe her parent was in the can or just out in the lobby for a sec. Think before you say things

It is my understanding that the unisex change rooms were for families to use (fathers with daughters, mothers with sons) sort of thing. If this is true, why was a grade 4 student doing in there alone? Should she have not been in the female change room, where this creep would have not gotten close to her?

No it is not a surprise for a man to be in a unisex change room...this is not the problem here. The problem is that he was sexually inappropriate with a grade 4 student. If you do the math it means this little girl was 9 or 10 years old! At no time EVER is it okay to sexually harass anyone! People who think this kind of behavior is ever invited could be considered "challenged" themselves. Kids should not have to be afraid to use the washroom when on a field trip with their school...or be afraid that people would ever think being sexually assaulted was their fault for going into a unisex change room. Considering this man was supposed to have 1 on 1 supervision...there should be more than one person held accountable for this action...and under NO circumstances should the child share any of the blame!

I'm sure if only there were more social services, government action, FAS education, healing circles, circle sentencing then this pervert would never have touched that girl!

A unisex change room? Well duhh! What is the surprise to see a man go in there. I would think that would be expected. If parents don't want their daughters to be sexually harassed, send them to a female change room. With all the so-called "challenged" people running loose, these things can be expected. And if the authorities really want to look out for people's safety, get rid of unisex change rooms, especially for children.

The question that need to be asked is, where was his one on one line of site supervision.

Perhaps the employee who had the role to provide 1 to 1 supervision should be charged with negligence or as co accused. The "accused" has already been deemed unfit to stand trial and therefore placed in what was thought to be suitable care. This suitable care was there to assist the accused in maintaining an abuse free lifestyle, as an external reminder and to keep the community safe.

It is the employee that should spend some time in solitary confinement. How is it that Everett is in custody when he was already deemed unfit.

Where was the group home worker when the alleged offence took place?
