Lot expansion bid includes man's land

Before city council could vote in favour of extending a lot on Squatter's Road in the McLean Lake area, a resident informed members the extension includes some of his land.

Gary Bemis spoke as a delegate at Tuesday evening's city council meeting to advise members he is finalizing his land title, which includes about 10 metres of land applied for by his neighbour, Linda Anderson.

'She said the lands branch had not told her about my plans for the land,' he said.

Anderson has applied to the city and the Yukon government to enlarge her land by 0.16 hectares with what she thought was vacant Commissioner's Land. The lots were created by the squatter's legitimization program of 1993.

'On the southern boundary, the 36 metres includes 10 metres of my application, which was approved by the city and YTG. This 10 metres is now in the plan before you,' he said.

Bemis told council his application is not for an extension, but simply for the title of the land he has occupied since 1987.

He could not produce a legal drawing of his property yet, because he said he had just found out about Anderson's application from last Friday's Star, and had not spoken to territorial representatives until earlier Tuesday.

Council agreed to defer the vote on Anderson's application for two weeks, until Oct. 22.

In the meantime, the city's director of administrative services, Robert Fendrick, said he would look into Bemis' concerns and resolve the matter.
