A Whitehorse man has launched a lawsuit against two local RCMP officers and the Attorney General of Canada for the treatment he allegedly received after being detained at the Whitehorse RCMP detachment more than three years ago.
In addition to special, general, punitive and aggravated damages, Arthur Joe is also claiming costs and prejudgment interest in the lawsuit filed in Yukon Supreme Court last week against Constables Kevin Mayes and Brian White and the Attorney General.
The lawsuit states that on May 10, 2003, Joe was detained at the Whitehorse RCMP detachment, where he was allegedly assaulted by Mayes and White, who were on duty at the time.
The claim then goes on to state as a result of the assault and battery, Joe suffered psychological and physical injuries along with other losses and damages. Of particular note, there was physical damage to his spine and shoulders, the lawsuit claims.
The injuries continue to cause Joe pain, suffering, the loss of enjoyment of life, permanent disability and a loss of earnings, it's stated.
He continues to need medical treatment for the injuries and is also claiming for services he's received under the Health Care Insurance Plan.
None of the suit's allegations have been proved in court.
