Jury finds accused man guilty

Whitehorse resident John White was found guilty of sexual assault on Friday afternoon in the Yukon Supreme Court. His sentencing hearing is scheduled for March 31.

Whitehorse resident John White was found guilty of sexual assault on Friday afternoon in the Yukon Supreme Court. His sentencing hearing is scheduled for March 31.

The jury's decision was unanimous.

White, 38, was not taken into custody, although he must not have any contact with the complainant nor leave the territory without prior written permission.

White was arrested and charged with sexual assault on March 16, 2007. His trial lasted three days last week.

The 22-year-old complainant in the case, who was one of the Crown's witnesses, testified that she and White left Lizard's lounge together at around 2:30 a.m. last March 16 and returned to his room at the mature students' dorm at Yukon College. She said she was intoxicated at the time.

The complainant said that once in White's room, she told him she did not want to have sex with him and just wanted to sleep. But when she woke up, she testified that White was �on top of her.�

�He was trying to force himself on me,� she testified last week. �I remember trying to stop him. I told him no, I didn't want to.�

The complainant said she left White's room at around 6 a.m. and went to the room of a relative who was also living in the mature students' dorm.

The relative subsequently called the RCMP, who arrived on the scene and arrested White later that morning.

According to White's testimony, after visiting several bars on the evening of March 15, he met the complainant in Lizard's bar, where she bought them both drinks.

When the bar closed, White said, the complainant asked if she could stay with him, to which he said, �Yeah, no problem.�

White testified that the complainant told him she did not want to have sex when they were back at his dorm room. He testified that this was �fine by me.

�There wasn't anything of a sexual nature and she knew it,� he said.

White said they both fell asleep and the next thing he was aware of was the complainant putting on her shoes. He testified that he then fell back asleep until he heard police �kicking at my door.�

Crown attorney Noel Sinclair called eight witnesses, including the complainant, three RCMP officers, two of the complainant's relatives who saw her that night, a DNA forensics expert, and a doctor who performed a sexual assault examination on the complainant on March 16.

Defence lawyer Gord Coffin called White as his sole witness.

Justice Leigh Gower presided over the case.


In an article headlined �Jury hears two versions of man's, woman's encounter�, published in last Thursday's edition, it was reported that White consumed �an ounce and a half of crack cocaine.� In fact, this amount referred to Scotch whiskey, not cocaine.

The Star regrets the error.
