Charles Anderson, 55, was sentenced last Friday to four years behind bars and 10 years' probation for raping an extremely intoxicated woman whom he drove home from the bar one night in April 2008.
The woman reported the attack after she awoke the next morning, naked from the waist down.
She did not remember having sex with anyone the night before, but did remember Anderson sitting across from her at the kitchen table, she later told the court.
The case remained unsolved for almost a year, until January 2009, when Anderson was convicted of molesting a 10-year-old girl and ordered to give a DNA sample to the sex offender registry.
That sample matched the DNA found on the woman's body, and he was charged with the rape shortly after.
At trial, Anderson denied raping the woman, saying she had initiated the sex.
The woman told the court that although she didn't remember most of the night after leaving the bar, she would not have had sex with Anderson because she was very close friends with his wife. She also said she avoided drinking alone with men because of past sexual abuse.
Yukon Supreme Court Justice Ron Veale heard the case and rejected Anderson's version of events, saying he knew the woman was too drunk to consent.
Although Anderson was sentenced to four years, which would normally be served in a federal prison, Veale gave him credit for 33 months already served. That leaves Anderson with 15 months in the Whitehorse Correctional Centre.
Anderson has been in jail since his arrest. He was not allowed out on bail because people in Carmacks said they did not want him living in their community while he awaited trial.
With nowhere else to go, Anderson remained behind bars for 22 months before he was finally sentenced last week.
As a long-term offender, Anderson will be under supervision for 10 years after his release.
He is not allowed to own any firearms and he must abide by any treatment ordered by his probation officer.

I am wondering why the courts didn't mention the other two young girls who were both 11 years old when they were molested and sexually assaulted in 1991. He is not a Carmacks man, he is from Dawson City.

Mr. Anderson should be thrown in Penitentiary for Life. These women are traumatized for life and he only get 15 months. I hope nobody ever takes him into their community. He is dangerous sex offender for life.

This is another example of our justice system failing us. It so awful that there had to be another victim after the 10 year old girl! So sad.

If he was convicted of molesting a 10 year old girl in 2009 why wasn't he already in jail?
