Hunter ‘should have known better,' judge says

Edward Bernier pleaded guilty to both charges in territorial court last week.
Bernier was with a friend when he shot and killed a bull moose while riding an ATV near the Faro mine in September 2012.
According to the witnesses who later called conservation officers, Bernier shot the moose, walked up to it, then left, the court heard.
Prosecutor Lee Kirkpatrick described the animal as a "trophy moose” with 65-inch horns.
Conservation officers went to the site the next day after having been tipped off by the witnesses. They found the moose half-buried by a bear. The meat was destroyed.
While the officers were taking notes at the scene, the grizzly bear returned to the kill, the court heard. The animal got within about 11 metres of the officers before leaving.
Bernier has said he could not find the moose when he went back to collect it, Kirkpatrick told the court.
But she pointed out that the conservation officers had no problem finding the kill.
Kirkpatrick read from a website which names Bernier as a guide for moose hunts. In court, Bernier denied ever working as a guide.
Defence lawyer Nicholas Weigelt, who appeared over the phone from Vancouver, said Bernier was acting out of character when he failed to retrieve the meat and was very remorseful.
In 28 years of hunting, Bernier has received only one very old ticket.
Kirkpatrick said Bernier was very co-operative and decided to plead guilty at the earliest possible opportunity.
In making his ruling, Judge Michael Cozens ruled Bernier is an "experienced hunter who should have known better.”
Along with the $7,500, Bernier has also been fined $1,125 in surcharges. He was given a year to pay.

I agree with Jackie. I feel exactly the same way. The animals are going about their lives just like we are and if people are going to kill them, at least have some respect and appreciation for what you are receiving from them, and what you are taking away.
I guess this never occurs to the people like Edward Bernier, or they get it but just do not care.

Hey folks...IMHO I think the results of this and other infractions reported on were HEAVIER for consequences than our regular (laughable) courts dole out in the criminal conviction world.
How many times have you read person X was fined $1000.00 for some charge that resulted in a dead/maimed motorist or pedestrian?
myself, too too many times to remember have I read such a thing.
Now we get the folks from DoE hitting dullards where it hurts...in the wallet/purse! If these were "converted" to some criminal code violation via the "law" courts, it would've been a slap or a good stern talking to Vs. tangible fines & other penalties.
The Dude whom was (gasp) responsible for killing the city's window painter in the canyon I believe was fined $1000.00 for his part of the chain of events.

Clayton. Our laws encourage this type of behavior. It's alway a slap on the wrist. If I wrote the laws, people wouldn't mess with animals. I would send you to jail for so long that people would think twice about disrespecting animals. And I can hear the whiners now about to call me a hippie environmentalist. No, I'm not a hippie. I just respect what God put there and so should you. Animals don't have a voice. They are just like you and me. Just living day to day. Raising a family. People who shoot animals for their horns or hide need to leave this earth. Don't meet me on the street pal. You don't want to see how mad I get over scum like you.

Why would someone kill a moose just to kill it? Disgusting! That would have fed my family for a long time! Myself, I am always working and can never have time off to go hunt for my family, which has to change, I will be teaching my son how to hunt with responsibility! This guy deserves a more severe penalty than $8,625 fine, should be forced to stay on an island with only a knife for a year, maybe than he would appreciate moose meat a little bit more than he does!
