Eatery owner feels ‘blind-sided’ by eviction

Plant-based eatery The Poor Creature will likely close its doors at the end of this month after the business’ lease inside the Yukonstruct building was not renewed.

Plant-based eatery The Poor Creature will likely close its doors at the end of this month after the business’ lease inside the Yukonstruct building was not renewed.

“I felt very blind-sided; it came out of nowhere,” Brioni Connolly, the owner, told the Star this morning.

Connolly said she was handed a letter by Glenn Piwowar, the president of the Yukonstruct board, and Lana Selbee, the staff executive director, last Friday afternoon.

The letter informed her that The Poor Creature’s term of lease would be expiring on Oct. 31 and would not be renewed.

Up until the delivery of the letter, Connolly said, she was under the impression she would be keeping the space.

Two weeks ago, she was put on the waiting list for new signage on the property.

She has a standing catering order with the organization every Wednesday, and they had recently discussed repairs to her sink and her terms going forward.

The letter – which gives less than a month’s notice of her business’ forced closure – has left Connolly grasping for answers.

She said she was told by Piwowar and Selbee that Yukonstruct would be “going in another direction,” but wasn’t given specific reason for the non-renewal.

“It seems pretty callous; it would be nice if they even had a good solid reason to hang on to, so at least I’d understand what’s happening,” Connolly said.

“They’re not even giving me that courtesy at the moment.”

Connolly said she reached out to the Yukonstruct board for clarification by email over the long weekend, but has not received a response.

“It’s very unfair for an organization that’s been mandated to serve entrepreneurs and support entrepreneurship,” she said.

Connolly opened the community-minded café last November.

The Poor Creature’s bill of fare comes from whole food and plant-based, ethical ingredients. The menu items do not include palm oil or refined sugar and the coffee is fair-trade organic.

The operation is also eco-conscious, with zero-waste policies. The café serves salads, bowls, hot food and baked goods.

Connolly said her business has been successfully received by the Whitehorse community and she’s been busy since opening.

“I feel like this business was something Whitehorse really wanted and enjoyed having,” she said.

Since she publicized the notice of her lease’s non-renewal last Friday afternoon, Connolly says the community has come forward in support.

Yukonstruct members themselves have expressed “dismay,” and told Connolly they hadn’t been informed of her business being ousted.

Connolly said she was surprised that so many members were unaware of the decision, because Yukonstruct has historically taken a collaborative approach to decision-making with members.

A number of people have reached out, she said, offering to help in the search for a new location for The Poor Creature. Connolly said she struggles to see a future for her café even if a new location is found.

“To be honest, I think if they go ahead with (the eviction), my business is dead,” she said.

“I’m sure (Yukonstruct) can understand that – that’s what they do, the support entrepreneurs. They know how delicate cash flow is.”

Connolly speculates the eviction might be due to complaints of the café’s noise level.

The space she occupies is open-concept. As a result, she was informed earlier this year that The Poor Creature was too loud for those working in the Yukonstruct spaces.

A previous board member told Connolly last February that the Yukonstruct board only realized the open-concept design was an issue after the café started operating.

She was told at the time that they would work together to solve the problem of the noise, and Yukonstruct members would be informed that working co-spaces were not necessarily quiet spaces.

Since then, Connolly has spent time researching how to solve the issue of the noise.

Last week, she invited Yukonstruct staff to meet so she could present them with solutions. Just a few days after she requested the meeting, she received the letter informing her she must vacate.

“That kind of compounded the surprise, because I thought we were working together,” she said. “It’s heartbreaking.”

Early this afternoon, Selbee told the Star in an emailed statement they are firm in their decision, but are willing to discuss a time extension.

“We as an organization have decided that this business is not the right fit and have chosen not to renew their lease,” Selbee wrote.

“We provided notice to the tenant as per the terms of our lease agreement and have offered to enter into discussions of additional time and transition support if requested.”

One thing to keep in mind, this is not your normal tenant landlord arrangement. The board should keep in mind that when you decide to take those multi million dollars of funding, it comes with strings. One would be that there should be transparency to the tenant and the taxpayer who makes your toy shop possible. At the very least the tenant should have an idea why no lease renewal. It’s not like having a restaurant wasn’t in the original design. If the board is looking for peace and quiet then maybe they should have not approved an open concept design. After all, from what I’ve seen it’s not a “serious” business atmosphere, and I hope it not intended to be. I thought it was a place your entrepreneurs to use for fledgling business ideas and a shop full of adult toys.

I've spent some time in that building, in the foyer, and in some of the meeting spaces in the back and while it is all very sleek and lovely, I must say my first impression was: loud crying from Poor Creature's child, which I understand since I have kids of my own, but was unattended to which bothered me, but despite that you're trying to run a business and you have a family so I get that also. I bought a coffee and went to sit down on the sofa or love seat or whatever that thing was and there was a dirty old dog on it, so I wandered off away from the dog hair and unattended to crying child and that was my first encounter, memorable for sure. My kids cry, but I don't ignore them.

I visited the place last month to meet someone and was a bit uncomfortable with the setup right there as you come in. In your face...The place looks quite cluttered and distracting for anyone expecting a business like environment.

That is cold. So much for the "third place" theory, if that entered into the design of this space.

For those sniffing that the board is operating legally, as I understand it, they're providing a service that nurtures entrepreneurship in ways you can't find on the open market. So they're under a moral obligation, if not a mandate, to act like humans when dealing with a young business. They had a chance to walk the talk and they blew it.

Two weeks is ridiculous. You don't have to be a rocket scientist, or one of the Dragons, to realize they've put her in a precarious situation for the survival of her business.

One side in this dispute feels it's legitimate to kick up a huge fuss in media/ social media when their lease is not renewed. The other side is unable to speak to specific details due to privacy being a landlord. Clearly there are longstanding issues that Yukonstruct isn't able to talk about. I for one am willing to recognize that as the public, we don't have all the information. And as far as I know, Yukonstruct has hundreds of members who are entrepreneurs, don't they? Are they required to support every single one of them, regardless of any issues that arise? We've read in the media that Yukonstruct is willing to offer them extra time in the space. Why aren't the owners of the cafe doing that? Do they think they have the right to be in that space, regardless of anything else or anyone else?

I encourage the Star and other journalists to chase down leads on this story.

What is this mysterious "other direction" that the Yukonstruct board talked about? Why the short notice in light of recent discussions re: continued catering to Yukonstruct? Are there conflicts of interest? Is politics involved? Do certain investors or politicians or government officials have undue influence?

As a "non-profit" NGO, Yukonstruct is VERY well funded with taxpayer's money.
I think the public deserves some answers.

No new business owner is going to sign a 3-5 year lease. The failure rate for restaurants in Canada is around 60% in the first three years.

As a landlord I will say that such decisions are very difficult and are rarely made over any single issue. In my experience it has been the result of repeated challenges over a period of time and in many cases not even entirely under the control of the tenant. So I don't know that Brioni/The Poor Creature necessarily did anything wrong, doesn't sound like it. The lease was to expire at the end of October at which point The Poor Creature could have presumably just walked away. It was incumbent upon them to secure a space, YuKonstruct or otherwise, to continue operating through the end of the month. It also sounds like there is an openness to provide a tenancy arrangement to allow The Poor Creature more time to find an alternate location from which to operate.

The board made a difficult decision and YuKonstruct has opened the door to allow Brioni to request more time and support to make a transition. I hope that such a negotiation takes place and the parties can find a path forward to get The Poor Creature a new home.

A Cafe was in the original design created by Mary Ellen Read Architect for the Yukon Innovation Hub, as was the 'open space' concept. It appears that the architect made a design mistake with a noisy cafe placed next to a quiet work space with no acoustic separation. People talking in the Cafe gathering space are making the objectionable noise, not the kitchen. Getting someone else to operate the kitchen doesn't solve the noise problem the architect created.

While I empathize with the cafe owner, it would seem her first misstep was to agree to create a new business based upon a 1-year lease. For a new business, a 3-5 year lease is paramount to building a loyal clientele and profitability. As well, negotiation of a new lease should have begun at least 4 months prior to the lease lapsing. As to reasons for non-renewal, none has to be provided by the landlord. The lease is up.

YUKONSTRUCT; To construct meaning to build, grow and develop? On the Yukonstruct website they state, and I quote “OUR MISSION : To provide access to communal space, quality resources, shared knowledge and a collaborative environment that helps entrepreneurs and makers”.
SHAME on all of the board of management at Yukonstruct for doing the COMPLETE OPPOSITE of what your Mission statement would lead us to believe.
Building a business from scratch takes hard work, long hours and utter dedication. Why destroy this new start up business within its first year of successful trading, when it is proving to be not only a success for the owner but ALSO for all of us in the community who frequent it!
The goodwill built up by the Poor Creature Cafe should not be underestimated and we should ALL be supporting a call to have this decision fully reversed!

If people really care about this business being blindsided, they need to show their support and let Yukonstruct know that treating lease holders and clients this way is not acceptable. A simple solution is to put up some walls around the cafe. They're going to want a cafe in there anyways, as she says she caters for meetings and such. We need quality eateries in the Yukon and if this is how we treat a cafe that is making great food then expect to be eating at Tim Horton's and McDonalds, especially if you don't stand up for small businesses that are local.

I wonder what Selbee means by the statement, "this business is not the right fit" and, 'YukonStruct is moving in a different direction"? The Poor Creature is a wonderful demonstration of a thriving, ethical, environmentally conscience and community minded business. One can only speculate as to what other influences are present on the board and providing direction... Their mandate is to support entrepreneurs, but apparently only those entrepreneurs who fit into YukonStucts board of director's "box".
How disrespectful that Brioni, a hard working, committed, dedicated and consciousnesses entrepreneur cannot receive an honest explanation as to why the board is essentially shutting her business down. I find their lack of integrity to be extremely disturbing. Don't give up Brioni - there are lots of us out here who will support you if you decide to relocate.

The business made a decision within the legal terms of its agreement with the Poor Creature. These days, if a person is entering into a lease, it behooves one to read all of it. Add a clause, if there is not one, saying, in the event the lease is not renewed, the landlord will give a solid reason for doing so or if a lease is not renewed, the landlord will provide the amount of the monthly lease for one year so that the tenant may have time and funding to locate a new venue. Anything really.. but people just sign away and get to work. The Poor Creature does not have any legal standing. She signed the lease. The owner/operators/board are operating with in that. She doesn't like it, but it's legal.

Just so I understand, an NGO that is government funded to support and bring up entrepreneurs essentially makes it impossible for an entrepreneur to succeed by kicking them out of their own building. Also this business is putting its money where its mouth is by reducing their carbon footprint and ironically is kicked out a week after the Territorial Government declares a climate change emergency and within a month of the CoW doing so. WOW I gotta slow clap that one.

The only part of Yukonstruct that actually made money and wasn't fully subsidized by the government gets the boot. How very Liberal of Yukonstruct. This organization has turned into a tax dollar money sink for Liberal lackeys.

Seems a bit harsh made all the worse by the extreme secrecy surrounding the notice. Does NVD buying the property have anything to do with this? We'll never know the truth.
