Deferment sought on

Whitehorse city council is asking a property owner on Squatter's Row to let it defer its decision on whether her lot can be extended.

Whitehorse city council is asking a property owner on Squatter's Row to let it defer its decision on whether her lot can be extended.

At Monday evening's council meeting, the city voted to ask property owner Linda Anderson for the deferment on her application to extend her lot into 0.16 hectares of land.

If she doesn't agree to it, the lot enlargement will go ahead with conditions that the city not be responsible for maintenance of the access road to it until the road is upgraded to city standards, and that the enlargement area maintains a minimum 30-metre setback at all points from McLean Lake.

The decision came after her neighbour, Gary Bemis, told council he had been in meetings until 4:30 p.m. about the land, which he also has an interest in.

The territory's land branch has stated previously it's been unable to find anything about Bemis' claim on the property. However, Bemis noted that with the late Monday afternoon meetings at the branch, they couldn't reach the city in time to discuss what had come out of the sessions.

With that, Bemis asked that the matter to be deferred.

City manager Dennis Shewfelt told council, though, the city would be past its 90-day limit for a decision if the matter was put off again.

With that, Coun. Doug Graham proposed the amendment that Anderson be asked to approve the deferment, but if she doesn't, that the enlargement be approved.

As Shewfelt pointed out, if there is an overlap in the property line for the enlargement, it can be dealt with when the land is surveyed.

Ten metres of land are in dispute, Shewfelt said.
