Glen Everitt, Dawson City's disgraced ex-mayor, will be permitted to move to Ontario after being sentenced to a relaxed house arrest and community service earlier this summer, the Yukon Supreme Court ruled today, but he will remain under Yukon supervision.

His 8 p.m. to 6 a.m. curfew will be monitored by phone and e-mail by his Yukon-based probation officer. She told the court today that if Everitt's sentence was formally transferred to Ontario, he wouldn't be monitored more than once a month, if that.

The probation officer told the court she had spoken with Everitt's sister in Chatham, Ont., where he plans to live, and confirmed his enrolment at a local college.

"They all exist, they're all real things,” she said of the various supports and educational pursuits Everitt outlined in his application to have his sentence transferred.

On Aug. 12, Everitt, 46, was sentenced to a 12-month conditional sentence and 100 hours of community service.

He was also ordered to repay the $38,300 of public funds he admitted to taking while he was mayor of the Gold Rush town.

The money he admitted to misspending was all related to travel expenses which were already paid for by his wife's employer or the Association of Yukon Communities, or were simply made up.

In today's application, Everitt outlined a host of medical issues which he says cannot be treated in the Yukon.

Those include chronic depression and chronic gastrointestinal problems which have led to severe weight loss.

His claim was backed by a two-sentence letter from his doctor, Gerard Parsons, who was unable to come to today's hearing, either in person or by phone; Parson's partner was "not willing” to speak to Everitt's condition or treatment, according to Everitt's lawyer.

Two of Everitt's sons and one of his daughters are already with Everitt's family in Chatham, the court heard today, and Everitt is enrolled in a two-year accounting course at an Ontario college.

Following his conviction, Everitt told reporters he planned to go down south to get an education so he could return to the Yukon and pay off the debt.

Until he can make more substantial contributions, Everitt is ordered to make monthly payments of $400 toward the debt. He has already made the first payment, his lawyer said in court today.

Although Everitt is currently unemployed, he is receiving survivor's benefits following the death of his wife.

He has also completed 41 hours of community service volunteering for the Tr'ondek Hwech'in, according to Everitt's application, almost half of the required 100 hours.

His probation officer suggested he put the rest of his hours toward tasks which would benefit the whole community, not just the first nation, she told the court today.

Everitt worked for the first nation until his health concerns forced him to quit, and leases a house from the Tr'ondek Hwech'in.

In making his decision to permit Everitt to go to Ontario, Lilles noted "It is important that (Everitt's) community service be done in Dawson and not in Ontario.”

Instead of transferring Everitt's sentence to Ontario's jurisdiction, territorial court Judge Heino Lilles simply amended his original order to allow him to go to Ontario temporarily. He must return to court in Dawson on Dec. 14.

Everitt served as mayor from 1996 to 2004.

I wish the Everitt family the best and hope that they are all able to put the past behind and start fresh and new! Especially the kids they don't need to have a constant reminder of what was as it was not their mistake but people tend to forget there are often families involved. Not to mention the negitivity of the media constantly being slapped in their face. Good luck!
