City council has agreed to reinstate the business licence of a Fish Lake Road couple who’d had it revoked because they did not have the proper permits for their dwelling.
Council, however, attached several conditions to the reinstatement issued last week.
If the stipulations are not adhered to, the business licence will be revoked for good, says council’s decision.
The Fish Lake Road residents had appealed the removal of the business licence. The appeal was heard and ruled on by city council last week.
Under the conditions, the property owners will cease all operations of their tour business at 185 Fish Lake Rd. by April 15, 2022.
Alternatively, they will bring the business and the property into full compliance with city bylaws and the conditional development permit.
The couple and anyone else using the property shall cease all use of the 16-foot by 16-foot cabin on the property unless and until the cabin receives a building permit and a final occupancy approval from the city.
The couple and anybody else using the property shall cease all use of the outhouse unless and until the outhouse is inspected and approved by all applicable authorities.
The city learned of the use of the property without permits as a result of noise complaints – dogs barking or howling – from neighbouring property owners.
Council’s decision also notes council does not agree with the couple that there was an abuse of power or other misconduct by city staff.
The property in question was subdivided off of property owned Icy Waters Ltd.

It would be nice to know why council did this.
Was it because the people on the property had a good lawyer? Having said this, my experience with bylaw has always been good and I would not assume they were heavy handed.

This is only part of the story, a fuller report was on CBC North web last week.
Cool, can't use outhouse, but no worries, there are lots of bushes.

The funny thing is, bylaw will only react to bylaw infractions when there is a complaint. Your sketchy operation was busted cause you were rattled on by a neighbor from hell. Someone was jealous or disliked you and weaponized the keystone cops employed by the city of Whitehorse against you.
Waste of taxpayer money and should be defunded, but they won't be cause they bring in cash.

Way to many bullsh-t rules in the city and it’s getting worse, bike lanes for people who don’t have insurance, crackheads, methheads ruining the downtown, every town you drive through getting to Whitehorse has modern hotels along the Highway except Whitehorse, but the city wants everyone to build downtown. Who wants to go downtown unless it’s absolutely necessary?

No reason provided (at least in the news story) for why council did not support their bylaw officers. Their jobs are sh$#&y enough without council stabbing them in the back.
