One of the two men convicted of second-degree murder in the December 2004 death of a former Carcross hotel owner wants his appeal of the conviction to be heard on its own.
Both Dean Boucher and Mark Lange are appealing their convictions of murdering Bob Olson.
During an appearance by video Tuesday afternoon, Lange told Yukon Supreme Court Justice Ron Veale that he'd like his case to be heard individually rather than having both appeals heard at the same time.
Lange's appearance was an update on the case. Defence lawyer Andre Roothman confirmed he will be Lange's counsel for the case, providing financial arrangements are worked out with the territory's legal aid office.
It's expected that will be finalized within the next month, with Lange's next court date set for July 4 as an update.
Following the July 4 date being set, Lange questioned Veale about whether the case would be heard.
Veale said he wasn't sure about it and suggested he speak to Roothman. Lange told the judge he would prefer the case be heard separately from Boucher's appeal.
Boucher also had an appearance by video, to determine whether he had a lawyer yet.
It was then that Boucher learned Zeb Brown had been appointed by legal aid as his lawyer for the case.
Questions came forward then from Boucher on how and when Brown was appointed and if he was a former Crown prosecutor, with Boucher telling the court he had told legal aid officials he didn't want a lawyer who had anything to do with the Whitehorse system.
'Now you say (they've) appointed a lawyer,' Boucher said.
Veale replied: 'That's what they tell me.'
He then suggested Boucher speak with Brown about the situation before adjourning the case for the day.
Boucher and Lange were both found guilty of the murder last year by a 12-member jury which heard the case over four weeks.
