Chief seeks apology over release order

The Vuntut Gwitchin First Nation has passed an emergency order to keep a known criminal out of Old Crow until a reintergrational progam can be set up.

The Vuntut Gwitchin First Nation has passed an emergency order to keep a known criminal out of Old Crow until a reintergrational progam can be set up.

Vuntut Gwitchin Chief Dana Tizya-Tramm held a press conference Tuesday afternoon in Whitehorse along with Kwanlin Dün First Nation Chief Doris Bill to explain their displeasure with the order from the Department of Justice to have Christopher Schafer returned to the remote village.

Tizya-Tramm said they learned of the decision late last Friday afternoon, when the First Nation received a phone call from the RCMP.

The community, he said, is not ready to accept Schafer without having a reintegration program in place.

Schafer is described in the emergency order to be a violent sexual offender as well as a serial dangerous offender who has committed offences against women and girls on the First Nation’s land.

Tizya-Tramm said the court order is an affront to the women and girls in the community who would have to face having Schafer in their community – and would have to see him.

The order, he said, was made without any conditions.

Tizya-Tramm was in court Tuesday to speak to the matter. The court case continued today.

The order to return Schafer to Old Crow is just one example of how many Yukon communities face these types of situations regularly, he said,

Chief Bill said the order was made with no monitoring place, no case management plan and no support whatsoever.

“It is left to the communities to deal with these individuals,” she said.

In many cases, she added, families are traumatized because they have to see these individuals on a daily basis.

“We have to give communities resources to deal with these situations,” Bill said.

“Communities can’t be expected to care for these individuals without proper support in place.”

Tizya-Tramm said they dealt with Schafer in a similar situation a year ago and were able to establish an acceptable method of managing the concerns and Schafer’s presence – but it took about month to put a plan in place.

In this case, he said, the community should have been told about what was being talked about.

Even last year, when the community of fewer than 300 people was given a month’s notice, it was not enough time to prepare, he said.

Tizya-Tramm is confident they can accommodate Schafer’s return under certain conditions, such as requiring him to live out on the land.

He said he was there not to judge Schafer but to say the community is not ready, but that he was there to help.

Bill said recommenations are coming from the Missing and Murder Indigenous Women and Girls inquiry as well as the Truth and Reconciliation Commission.

“We need to start implementing these recomendations,” she said.

“Right now, we are setting up these individuals to fail. That is not fair to them, it’s not fair to the communities and it’s not fair to the families.”

Bill said she has invited federal Justice Minister David Lametti to the Yukon to get a better understanding of Yukon communities and First Nations.

Tizya-Tramm sent a letter Tuesday to Lametti, territorial Justice Minister Tracy-Anne McPhee and Judge Michael Cozens, the chief judge of the territorial court.

“The release order of the territorial court of Yukon was made with no prior notice of consultation with the Vuntut Gwitchin First Nation nor any apparent consideration of the safety of our community, and in particular the women and girls within our traditional territory,” the chief wrote.

He said the release order prompted the emergency declaration to keep Schafer from returning.

The case is another example of not treating the communities with the respect they deserve, he suggested.

“... The decision of the justice of the peace of the territorial court of Yukon to make the release order demonstrated a total lack of disregard for the safety and well-being of our community and the women and girls within our traditional territory and our responsibilities as a self-governing First Nation,” the letter says.

In his letter, Tizya-Tramm calls for an apology to the citizens of the First Nation and to the community.

He also called for a public inquiry into the direct and systemic factors that contributed to the release order.

The letter also calls for community wellness supports, counselling and aftercare on a permanent and ongoing basis for any Vuntut Gwitchin citizens affected by the order.

Renée Francoeur, a spokeswoman for the territorial cabinet, said in a statement this morning McPhee’s office will provide a response to Tizya-Tramm’s letter.

Francoeur goes on to list the services of the territorial victim services branch, and how it provides a long list of how staff help victims of crime and offenders.

The Dawson City Mental Wellness and Substance Hub pro-vides services to Old Crow.

An additional community counsellor is dedicated to Old Crow and travels regularly to provide services to the community, says the statement.

Truth seeker. I would like to know what happened to all the money that FN's were given to create their own police force? If OC has RCMP Officers and a Probation Officer why is this even an issue? Isn't it their job to supervise these offenders like in any other community? It has been many years since the signing of Land Claims and still only 1 FN has their own force. Why? I sure hope that VTFN is in the process of developing a safe plan for the community because I have a feeling that Mr. Shafer is going home. Other FN's have welcomed offenders back to their community. This is not an isolated incident. I believe that Mr. Shafer should be labelled a dangerous offender.

I am no longer in the system. It is so corruptly politicized that I was unable to stomach the ongoing lies and deceit. It was entirely demoralizing to watch the ongoing violation of legal, and judicial ethics. To watch lawyers lie, deceive and withhold evidence.

Lawyers would tell you it’s political. I would counter that it’s not supposed to be political and that such politicization cannot be tolerated in a democracy. This is extensively written about by legal scholars. It is a part of Judicial ethics.

However, these Judicial ethics are often essentialized as “you can’t tell me what to do because I am the law”. This does not bode well in a democracy wherein in its key-holders, supposed guardians of the public trust, exhibit elevated levels of narcissistic traits. But then so do politicians.

This is the danger with Chief Tizya-Tramm’s assertions. It is the difference between the application of law and the manipulation of law to achieve a political purpose. And this is the assimilation that was intended - Political corruption. Leaders as authority rather than examples to be emulated.

I am not sure how the electorate tolerates this state of affairs. But then we know that intelligence and attention spans are decreasing. We see this everywhere with the rise of totalitarianism in the form of identitarian constructs.

Noam Chomsky wrote in the context of education and economics that the division of labour was intended to make people as ignorant as is humanly possible. We see this paralleled in the hierarchical construction of identity politics as people are assigned categorical identities.

This is specifically designed to eschew any sense of reality, to distort facts, and to deprive people of a common language so that we can discuss this nonsense they are foisting upon ‘us’ so they can make wholesale systemic changes with little or no resistance.

It’s later than you think… Wakey, wakey!

You need to put your big boy pants on Chief Dana Tizya-Tramm. For far too long the victim card has been played by your community. You don't seem to give a damn if "one of your citizens" is free to create mayhem in another community, as long as it is not in your backyard. Suck it up and learn to live with the monsters in your community instead of passing the problem onto someone else to look after.

For too long "huge" amounts of social assistance monies have flowed into your FN from Ottawa. It seems to be always the same though "we don't have the resources". Well now whose fault is that? If in the past you received funding to establish programs and you fail to do so, or pay lip service to the purpose, of the funding that is on your community, no-one else. Don't keep coming back to the trough looking for more. You want self-determination and be established as a government in your ways - well then it is more than high time you start walking the talk. As it is now you are just another whiner who believes there is a golden pot at the end of the rainbow that is never ending available to you. You must learn to accept responsibility - true responsibility - for what you want, and have. If you keep choosing to expect everyone else to come in a fix your problems than you had best rethink your aspirations. Why? Because they do not match what you are doing.

I can appriciate that there are growing pains to adopting a self-governing position for the many things a new government is responsible for, but when the negociations were conducted didn't anybody sit back and imagine what would it mean IF they got what they lobbied for in creating self-governments?
Its time for the training wheels to come off and step up to being a responsible government in all things.

It should be pointed out, in case you were being literal, that the protections afforded by the concept of Judicial Independence which are meant to be bidirectional protections. They are to protect the Judge and the judged. They are expressly intended to guard against the influence of the one over the other. There must be a bright line separation between the Judiciary and the Executive.

Under the umbrella of Judicial Independence Judges are required to conduct themselves in a manner that is not only impartial but is seen to be impartial, to be free from any influence or bias… This is another one of those pillars of democracy that have been knocked over more recently. The Liberal Coliseum will come tumbling down sooner or later

It’s easy to hate Chris Schafer for the wrongs that he has perpetrated and perhaps excuse this overstep by Tizya-Tramm. Two wrongs do not make a right. There is and has been political interference in Chris Schaefer’s matters.

The evidence is there.
But hey, let’s ask this question why not?

Is Chris Schafer less of a risk living in a coed, communal living environment, with shared facilities, no security, with access to drugs and alcohol, in a living environment where there is no security, and high levels of substance use disorders, and mental health concerns, or living in a remote cabin outside of Old Crow?

This is the choice that a judge made previously notwithstanding Schaefer’s apparent high-high risk status that supposedly warranted putting him on an 810.2 Recog out of a fear that he “may” commit a serious personal injury offence against a woman.

This was stupidly political! However, another feature of Judicial Independence is that Judges are not liable for the consequences of their decisions - That’s right, zero liability. But this is necessary because the lawyers include and exclude evidence that is favourable or unfavourable to their case.

Every Canadian citizen must be able to depend on a justice system that is free from any outside interest or influence. This principle of independence concerns both the institution itself and those who apply its rules, i.e., the judges.

A fundamental principle is at the heart of the Canadian judicial system is its independence. The "separation of powers" guarantees Canadians that the legislative, executive and judicial powers in Canada will be autonomous and independent of each other. The legislature defines the law, the government ensures its application and the courts interpret it.

When a dispute is brought before the courts, both parties must be convinced that the judge will render a decision based only on the law and the evidence submitted. Judges must be completely impervious to any outside influence, whether governmental, political, family, organizational or other.

In short, judicial independence is essential for Canadians to have confidence in their justice system. We must be convinced that the judge will render a decision based on his or her conscience, in full respect of the oath of allegiance taken when the judge was appointed. Any breach of this fundamental principle may be reported to the Canadian Judicial Council.

Schafer's modus operendi. This was what he pulled in Whitehorse, 20 years ago. One of his 19 convictions: "On the night of Sept. 29, 2002, Schafer walked into an unlocked apartment on Fifth Avenue in Whitehorse and attacked the two women he found sleeping there with a knife.

The first woman awoke to find Schafer, completely naked, standing in her room with a 19-centimetre kitchen knife in his hand.

Despite the woman's efforts to fend off the man, Schafer managed to rip off her pants and underclothes before her friend, who was sleeping next to her saw Schafer choking her friend. She attacked him, enabling her friend to escape and go for help.

Meanwhile, Schafer dragged the second woman into the living room by her throat, then fled when he realized his first victim was bringing reinforcements."

This is a complicated story, for sure, but I am fixated on the matter of the Chief invoking some kind of emergency measures for Old Crow. This must be the third or fourth time he's done that, is that right? The other times being for Covid.

One thing that bothered me about those kinds of powers is the possibility that they would be used for other things, in a way that wouldn't have been attempted before.

I can understand the concern over this particular person, but this chief is continually suggesting some kind of exceptionalism. He doesn't like a court decision, well, obviously, there are ways and means to communicate that, and to affect the outcome, before exercising his big stick of declaring Old Crow off limits.

This is the same chief who will be arguing in the Supreme Court that his First Nation shouldn't be bound by the Canadian constitution. I'd love to see the media here delve into some of these things a little more deeply.

@Max Mack on Oct 12, 2022. They were given resources to deal with these problems. Maybe the problem is, it was given in money instead of counseling training. These communities have to set up their own committees, then be properly trained to conduct the business of those committees. But the so called wise gurus of government departments think that just cutting cheques will solve their problems. Stephen Harper tried to make FN accountable for all the money they received, but what the lefty judges didn't have time to throw out, the JT liberals repealed when they got in. So, instead of cutting cheques, put the money in training. With all the millions being given out, somebody is getting rich. FN have a saying they like to tell everybody, "give someone a fish, he has food for a day. Teach him how to fish, and he has food for life". So, train the people how to look after their own instead of cashing the cheques and turning their backs on their community family members.

We have a serious offender. We have a court that set him free. We have a FN that has insisted unceasingly, that they want their own justice, their own HR, their own finance, their own child protection, their own traditional healing... their own everything, and as taxpayers, we have footed that bill. They want everything but this dude, they don't want him, AND they want an apology for the Court thinking they did.

That being said, all politics aside. The RCMP, the FN, the other guys, the Court, all agreed and recognized that "Schafer is described in the emergency order to be a violent sexual offender as well as a serial dangerous offender who has committed offences". So, why did the Court release him? And why isn't the Government, (Liberals) pursuing changes in the laws that permitted the courts to set Mr. Schafer free? It isn't enough for the Government, who owns the judicial authorities, to sit back and say, it's the law, the guy did his time, and had to be set free. They need to go after the system. The Court deliberately, and knowingly, put the public at serious risk. They warned us. Big whoop. BTW..I don't care what color the victim was, or where the crimes occurred. A crime against one girl is a crime against ALL girls. A crime against women, is a crime against all women. All women and girls, and the men that protect us have to start demanding laws that do not continue to create and sustain victims.

We’re getting lost pointing fingers at each other here.

The crux of this is that a judge released this person knowing he’ll likely reoffend. The system is the problem. Everyone else has to bear the consequences. Rehabilitation for sexual offenders is a farce. Recidivism rates speak for themselves. There needs to be some accountability framework put in place within that system. If their theories on restorative justice create more victims, how do we redress that and achieve policy change? The first step is to admit failure. Who among our venerable judiciary is brave enough to do so? Anyone?

Very disgusting and shameful politics and bantering on your behalf. Make him wear an electronic ankle bracelet. You're gonna need it if you want to keep people safe around him and even that probably wouldn't stop him.

If he hasn't lived in the community since the 90's, I'm sure there would have been vigilante justice by now if he were residing there. Can you blame them for trying to protect the women in their community? Clearly he is a danger to any women he encounters. Why hasn't the justice system labelled him a dangerous offender by now? So no women anywhere are at risk. This isn't unique to any community. Everywhere there are people who are evil to their core, lifelong criminals who will never get better.

In my humble opinion, the Chief is abusing his authority by invoking an emergency order. The guy has done his time. That is not what emergency orders are for.
Like others have said... he's yours, Old Crow. Deal with him in your traditional ways - isn't that what we hear is the goal all the time?
Why do FNs get it both ways? He's yours when you want him to be yours; he's not yours when you don't want him to be. Wtf? What makes you so special?
I agree with the post that says the Chief owes the rest of the Yukon an apology for trying to put him anywhere but OC.
Take care of your own dirty laundry in your own special way. Don't dump it on the rest of us.
Chief Bill, I'm surprised to see you up there calling for the offender to be sent to Whitehorse. Will you be crying foul when a KDFN woman is accosted by this guy?

There is a whole lot of irony here in this previous article from CBC:
Larochelle said the decision is also important as a "milestone" in how courts recognize the reality of Indigenous people, over-represented in the corrections system and often displaced from their home communities as a result.

"[The court] is becoming increasingly sensitive to the cultural contexts and the rights of Indigenous people and how those affect the interpretations of statutes," Larochelle said.
Meantime, MLA Annie Blake, speaking from Old Crow on Thursday afternoon, said she was glad that Frost's challenge is now over.

"I'm really excited to just move forward and continue to work on relationship-building with the entire community," she said.
So at one time Schafer is the example used to indicate the Justice System’s sensitivity to cultural concerns for Indigenous rights and peoples to then be used as an example of the Justice System’s insensitivity to those same issues… FFS!

It makes one wonder at the political manipulation of the Justice System… Tizya-Tramm seems to be advocating for a Justice System ruled by the mob, with their thoughts and feelings, the psychological manifestation of pitchforks and torches come to bear upon and influence the nature of Justice itself… Chaos and uncertainty through authoritative emotionalism in world of manifest pain and trauma…

Well done Justice System! Well done Law Society! Well done PPSC! The sham continues and takes a hard right towards an ‘Indigenous Fascism’ (IF). Is Justice served, not sure, it’s kind of IFfy!

And yes, this is the guy who cast the tie vote for the NDP, which resulted in Kate White calling the shots for the Liberals in return for keeping them in power through an agreement. The whole house of cards rested on the fact that Christopher Schafer was a member of the Old Crow community. Community leaders testified to that fact! Now that they got the MLA they wanted through an apparent slight of hand, they say he is not welcome to be a member of their community, and they are angry that he was to be sent to Old Crow!!

You can't have it all ways and sideways. This is ridiculous and I think on the verge of totally corrupt. Like they didn't know a year ago that they didn't want him in Old Crow?

Okay, he did his community service during the election. (Interesting...he counted then). Now, they want to throw him to the curb. Sooooooo, here's my question. Old Crow, though he is a citizen (when he counts), now where do they think he should live.? Whitehorse???? Once again, these FN communities, who no longer want to support their citizens (yes this had happened before), want the good ole City of Whitehorse to take up the cause. GET REAL, FN. Do not throw out there, this is a failure to the TRC. This is a failure in your community that you want to pass on to our community in Whitehorse. Once again, we are expected to pick up the pieces. Sex offenders are created by actions of others. These actions of others are what created Chris Schafer. Is Old Crow Chief so naive that he believes Chris just became that way? Or are they protecting the people that violated him as a child. Old Crow finds Chris Schafer a rare person wthat is Whitehorse's problem. When in fact Old Crow has many sex offenders living in the community. So what is the difference between them and Chris besides the fact that he served ten years did numerous courses to deal with his problems. Has not reoffend in a predatorial way towards women or chidren for ten years but has committed robberies, assaults in fights defending himself and robberies because unlike all other Old Crow offenders he got zero support from the band because the person he assaulted brought shame on the world stage to the community of Old Crow.
There was actually a contract put on Mr. Schafer by the father of the victim. I hate pedophiles and I hate rapists to the core but I don't believe for a moment that this chief or Doris Bill is being forthcoming. Chris has land in Old Crow he has family he has 20 years of counciling what else does Old Crow expect the tax payerz of the Yukon to provide for Chris, we did not create Chris Old Crow created Chris and now Chris after 20 years of being away is coming home. He wants what's owed to him and his family tell the whole story don't just give CSC and Old Crow Chief to bann anyone because a sexual assault it doesn't matter try and convince the victim that there's a difference. There isn't. Old Crow does not reserve the power to deny Chris access to his family or his land he has completed everything he was required to do so will he reoffend in a sexual nature his chances are far less than those who have done it multiple times and still live there.
The Emergency Act has been abused by this chief and has now set up Old Crow to a court battle that won't stick to the facts of the past but of today. I find it amazing how he thinks that he as a chief knows better than a judge or assume that the judge never took Chris's past record into consideration before releasing him. I hope the truth comes out and the people responsible for creating Chris are held accountable.

This is the same guy that Kate White and the NDP and maybe even Chief Tramm were advocating for during the election. They said he was a member of the community and so he was allowed to vote in Old Crow for the election. The election was then decided by a coin toss.

Now all of a sudden they go back to viewing him as an unwelcome threat who should NOT be part of the community??

They birthed him, they raised him, they keep him. They were given money by the governments to help these kinds of people in their communities. They have no right to force them on other communities and Whitehorse. Why should they be free to commit sexual crimes etc. against our citizens in our communities? So, let the elders deal with their own people the traditional ways. Keep them out of ours. We have enough problems in our own communities.

Gee...another opportunity to ask the all knowing a legit question on how “traditionally” such a matter “was” dealt with?
I thought Whitehorse was the default roaming ground for community offenders?
Given that the courts, which enable in particular traditional criminals, are here they must need a place to free range whilst breaching orders on the daily.
Funny all criminals/scumbags regardless of the pigment OR gender, do not follow society’s rules and court orders...imagine that eh?

Personally folks as this predator, need a dirt nap is my view.
Pretty certain most cultures traditionally dirt napped folks as he!

I believe the communication needs to be improved. It's understandable that many people are upset by this situation.

I hope this man can return to Old Crow, it may be a path to his healing and eventual support from the Community of Old Crow.

Whitehorse Star - There is nothing in this article that explains the circumstances that led to this persons release. is he out on bail? Did he complete a sentence ? Isn't this the same fellow who insisted on his right to vote as a resident of Old Crow? Most important - are there laws in place that permit a community to say that someone can not live in that community after release ? That works certainly solve a lot of Whitehorse problems. I'd feel a whole lot safer if certain people were not allowed to stay here after their incarceration. Or do sone communities have legal rights that others don't ?
