Cabbie killer's sentence delayed

Mike Dale Hamilton was arrested after a Whitehorse taxi driver's body was found near the Mountain View Golf Course entrance in June 2004.
The 24-year-old was supposed to be sentenced on April 20.
However, on Tuesday, his lawyer, Malcolm Campbell, asked Yukon Supreme Court for the matter to be postponed after it was determined that a pre-sentence report and a psycological report were not going to be available for that date.
Such reports would evaluate the personal factors in Hamilton's life that likely played a role in his decision to commit murder.
A judge uses often uses reports like that to determine what sentence is appropriate for an offender.
Both Campbell and prosecutor Nils Clarke will likely not be available to deal with the sentencing until September.
The adjournment will now give Clarke and Campbell extra time to prepare a statement of facts about the murder.
The sentencing is expected to take two days, as all the reports will first have to be presented to a Supreme Court judge before he makes a decision.
A date for the sentencing will be selected on April 26 in Supreme Court.
Hamilton's victim, 5th Avenue taxi driver Brian Wheldon, was 68 years old.
A second-degree murder conviction carries a sentence of a minimum of 10 years' jail time.
