Cab driver exposed himself, court concludes

A local taxi driver has been found guilty of exposing himself to a young woman in his cab and trying to force her to touch his penis.

A local taxi driver has been found guilty of exposing himself to a young woman in his cab and trying to force her to touch his penis.

Mohammed Abdullahi pleaded not guilty to the charge against him, but was convicted Friday by territorial court judge Michael Cozens after trial.

Abdullahi was charged last summer after a young woman reported being assaulted in his cab.

During the trial, the young woman told the court Abdullahi picked her up as she was walking down Two Mile Hill in the early-morning hours of June 20, 2009.

She was walking back to her downtown home after being unable to get into her father's house in the Takhini North subdivision.

The young woman was scheduled to leave town the next day and was crying as she walked, she testified.

Halfway down the hill, a minivan cab passed her going in the opposite direction, did a U-turn and pulled up beside her.

The cab driver, who she identified in court as Abdullahi, asked if she needed a ride. She said she had no money, but got in anyway and directed him to her house downtown.

Abdullahi drove to the bottom of the hill, then turned in the opposite direction, she said.

The first time Abdullahi touched her, he put his arm around her shoulders as if to comfort her, the young woman said.

When she shrugged him off, he undid her seatbelt, took her hand and put it on his thigh. She pulled away and refastened the belt.

Then, she said, Abdullahi took her hand again, this time placing it around his exposed penis.

The woman said she began yelling at the cabbie and told him to take her to a friend's house in Porter Creek. He complied and did not try to touch her again, she testified.

Once she got to her friend's house, the woman said she was nearly hysterical with fear and anger.

Once she was able to get the story out, her friends tried to call the cab company to complain, then realized they should call the RCMP instead – something the woman said had never occurred to her.

Abdullahi's lawyer, André Roothman, pressed the woman on why she didn't call the police immediately, and suggested that she made up the story.

The woman stuck to her story, however, and when asked why she didn't think to report the incident, said: "I'm not very educated about sexual assault. I knew what he did was wrong, but I didn't know what to do about it.”

Abdullahi took the stand in his own defence and said the entire story was concocted.

He claimed the woman had first asked to go downtown, then changed her mind and wanted to go to Porter Creek with a stop at a trailer park along the way.

Once they got to the Porter Creek address, the woman claimed she didn't have any money, Abdullahi said.

She went inside the house, with a promise to return, he testified, but after waiting for a few minutes, he figured it was a lost cause and drove away.

As the judge pointed out in his final decision, Abdullahi never reported the ride-and-dash, nor did he produce the night's trip sheet on which the lost fare would have been documented.

In protesting his innocence, Abdullahi claimed he would never treat a woman in such a way because he is a married man and a Muslim. His faith prohibits such behaviour, he said.

But that claim opened up Abdullahi's character to the prosecution. Crown prosecutor Bonnie Macdonald put Abdullahi's ex-girlfriend on the stand to recount the couple's first date.

They were at the Qwanlin Cinema watching a movie, Abdullahi's ex testified, and kissing.

Much to her surprise, Abdullahi took his date's hand and placed it on his exposed penis, she told the court.

She said she was horrified and upset and refused to answer Abdullahi's phone calls for several weeks.

She eventually forgave him and the two ended up dating seriously and had a daughter together. The woman broke it off when she found out Abdullahi has a wife and children in Yemen.

Abdullahi's lawyer tried to have that evidence thrown out, but the judge chose to consider it in his final decision.

In finding Abdullahi guilty, Cozens said that while the victim's testimony was clear and consistent, Abdullahi's was not.

He found the 50-year-old man guilty, but put off sentencing until a pre-sentence report is prepared by Abdullahi's probation officer.

Since he was first charged with sexual assault, Abdullahi has been barred from taking any lone females in his cab.

That order still stands while Abdullahi waits to be sentenced, for which no date has been set.

This person should not be granted so much mobility and opportunities to expose his penis. If he does not citizenship here, why keep him?

Mohammed is not God in the Muslim religion or in the Arabic language.

The Arabic word for God is Allah, and

Muslims believe that Allah is the same

God worshipped by Christians, Jews, and

Muslims-- all monotheists.

For Muslims, Mohammed was a prophet of Allah, as were Abraham and Jesus.

The Mohammed who has just been convicted did a very bad thing. I have known some Abrahams and at least one

Mexican Christian named Jesus who also

in their lives failed to honor those for whom they were named.

Kailey, Sarah, the one thing I would say is that the accused in this story is the person who brought up the fact that he is Muslim, and wanted credit for that. In fact, this is what allowed the judge to question his character. So even our laws say, hey, if you want to lean on something to suggest that you are of good character, you better be able to back that up. Do not complain when people look into it and refute your claims.

A muslim who goes on about his good character toward women, citing a religion, as practiced in the middle east, which is full of misogyny, is rich indeed.

His behavior toward this girl is actually in quite in line with a low view of women as held by many, many muslims who immigrate to Canada. Deal with it and say it like it is. I am not sure which country Mohammed moved here from but in some, if a woman is not wearing a bag over her head and furthermore is not trailing behind her male keeper, she is fair game. It is no different than slavery and abject racism but for some reason women are supposed to keep their mouths shut about this affront to their dignity in our own country? Sorry Sarah.

Mohammed the cabbie opened the bag of worms that his religion should make him above consideration of wrong doing against women. That is a total joke and he was found guilty.

It is not about culture, rather it is about a man who was USING his culture and religion in an attempt to thwart justice.

Nice...

But I'll bet we've seen that before eh?

Ask that young girl if she felt terrorized...

I think the racist stereo types need to be left out of this discussion. The real issue here is that this guy did a disgusting act and should be punished for it. Skin colour, origin at birth, name and religion have nothing to do with this situation, and those who think they do are uneducated and ignorant.

Not all bad people are of other origins, look at Bernardo and Homolka... last time I checked they were both white and from here. After all these posts Bob I hope you realize the errors in your comment and can learn something from that.

So many problems in todays society (not all) are caused by immigrants.

Its time for canada to tighten its laws and seriously review each application, as well as keep tabs on them closely for 10 years. Im sickened by our government that lets just anyone in

Give up on the education angle, its old, and never justifys itself because you do not know the person.

Oh btw, our soldiers also died to make the STAR censors our comments with no explanation whatsoever.

What is wrong with you people. Just because they are Islam doesnt make them terrorists. That is just a bad sterio type. Grow up! we live in Canada the land of the free. Canada is a great place to live, who wouldnt want to come here.And at no point in this message Im I saying what the cab driver did was right. What he did is wrong and should have to pay for what he did. But why does everytime something happens race comes into play! Sad very Sad

Smarten up Bob. just because his name is Mohammed and he's a certain religion does NOT make him a terrorist. Yes What he did is sick and he should defiantly get a hard sentence but not every Person named Mohammed or every Islam is a Terrorist . so dont be so Ignorent Bob cause what are u American?

Just cause his name is Mohammed does not mean he's a terrorist thats just some of the racist comments from people that don't know anything blab about!

I think you seem to think that just cause someone is middle eastern their automatically a terrorist? How about the Canadians or Americans that did terror attacks such as Timothy McVeigh the Oklahoma bomber or Eric Harris and Dylan Klebol the Columbine shooters?

So as an Iranian woman who knows more about culture than you probably ever will I suggest you keep your comments to yourself cause you are just showing everyone that you are not educated enough about what you are talking about.
