Avoid rogue trail builders’ trap, council is urged

The head of Active Trails Yukon is calling on the city to scrap proposed policy wording that would legitimize what’s now illegal trail building.

The head of Active Trails Yukon is calling on the city to scrap proposed policy wording that would legitimize what’s now illegal trail building.

Keith Lay appeared before council Monday night, asking that council not move forward with the plans.

“On Oct. 17, city administration is scheduled to reintroduce its proposed changes to the recently updated Trail Maintenance Policy, change that will tell rogue trail builders that constructing a trail without going through the required application procedure will quite probably lead to the trail being approved by the city,” Lay said.

“In fact, if rogue trail builders come forward and admit their sins, administration will actually “(consult) and (co-operate)” with the rogue builder in order to turn the illegal trail into an official city trail.

“If city council approves these proposed changes, it will be falling into the trap set by rogue trail builders.”

Lay then went on to argue that rogue builders begin construction and get as much done as possible before the trail is discovered and reported to the city, knowing it can take some time before authorities can deal with it.

“This is often the case for many jurisdictions that have extensive trail systems to maintain,” he said. “Rogue trail builders count on these facts.”

Lay then stated most of those trail builders expect that eventually someone will suggest finishing the trail and go to a local club that uses trails to ask that the group go through the proper procedures to finish or seek the group’s support to go through the proper application process.

“When faced with an application supported by the club or trail steward, which often offers its help in completing and/or improving the trail, the authority (in this case the city) involved sees ‘a way out’ and approves the application,” Lay continued.

If the city moves ahead with changes to the policy, it would essentially allow trail builders to make their own routes without going through the application process.

The change in wording would see additions to Section 26 of the policy to state that both rogue trail and city trails may be temporarily closed or deactivated where there are safety or environmental issues until the issue is resolved through clean up, maintenance, rerouting “or approval”.

Outlined are steps to take when considering deactivation or closure.

Consultation and co-operation with “rogue trail builders” or local trail stewards is listed, along with posting notices, fencing or barricades as required, and monitoring of the area.

“It is a ‘win-win’ situation for rogue trail builders, and only encourages the ‘build first’ route that has proved so successful for such builders in other jurisdictions,” Lay said.

“Unfortunately, although a ‘win-win’ situation for rogue builders, it is not for the environment, other user groups, or the community or land authority that has to bear the cost of such illegal activities.”

He then issued the call for council to reject the changes expected to come forward in two weeks.

“We urge council to reject the legalization of rogue trails and to send a message to anyone contemplating such construction that our city rogue trail construction is not to be tolerated or rewarded, and that all such trails will be closed permanently with no possibility of future approval.”

Council will discuss the matter when staff bring forward a report and recommendation on it.

The City has had an established trail application process for years. Now is not the time to consider circumventing that process. What we need is GENUINE community consultation with regard to trail development. A well-planned trail network is what we need in Whitehorse. What we don’t need is deals made behind closed doors with rogue trail builders, nor do we need a mess of braided trails fragmenting greenspaces, far too much of that already.

Many thanks to Keith & Active Trails for shining the light on this dubious proposal. In Whitehorse it’s gotten to the point that in many areas there are more trails than green spaces, what with the ORVs and mountain bikes carving and cutting.
Why would the City even consider weakening the trail policy... it will only encourage more rogue trails, which are difficult and costly to repair.

I am very tired of this kind of negativity and toxicity that ATV continues to bring to trail use in Whitehorse. The consultation process clearly showed that almost everyone else supports trail development and trail usage in Whitehorse. I hope the City will be firm in not allowing this one-man show to continue a long-lost battle. Stop wasting my tax dollars.

Trails are a positive and healthy thing for our community!!

The City's trail approval process is still very new. I think the City is being fair and reasonable by considering trails begun outside of the new approval process. And if so many other jurisdictions are taking a similar stance, it's likely a reasonable one.

Whether one walks, jogs, bikes, or uses fossil fuelled units folks really like the buzz being outdoors brings.
That said TOY should rename buzzkill fascists.
One really awesome thing about having a post election economic beheading.....is that many of these types of folks will return to their commune.
Very very often, but not always seems they are far from here those communes.
The place is yuuuuge, why can we not just enjoy and share the epic space?

Just sayin nailed it. Mr Lay and his few liked minded associates in ATY are nothing but a negative influence in all planning processes. Mr Lay happily trail runs on the trails that others have built, some of which began as "rogue" trails, yet is never seen out maintaining said trails. He and ATY actively campaign against any motorized trails whatsoever. I'm not a motorized trail user, but I recognize that others have a right to enjoy their chosen activities and all users need to have input, not just ATY and their supporters who tend to yell the loudest. Other user groups such as the KSA and Contagious Mointain Bike Club work well together, then ATY shows up and there goes the show.

Great, another trail within the new Chadburn Lake park. I went to many of the City planning meetings and thought there was a public process for new trails.

And yes, many trails were built when someone ran a cat here or there but this is 2016 and you really should need to have a little consultation and approval. Let's not return to the 1950's, life was harsher back then and there were not many government jobs.

I want to build a quiet biking trail from Pineridge to the SS Klondike. Any volunteers out there. If the city catches us they will just finish the trail and make it wider and safer.

Activist Trails Yukon. Ha ha. Do you ever have anything positive to say or add to a discussion? I have seen you at several meetings and all you ever do is create controversy and cause bad blood.

Most every trail in Whitehorse was created in exactly the way you claim to despise, however you vilify everyone involved.

Most of these trails were built over the last hundred years by exploration, loggers, woodcutters, Motorcyclists, Snowmobilers or locals, seeing a particular need to get to a specific location.

These Trails are now seen as an asset to the city that it advertises world wide that people should come and see and enjoy.
City of Whitehorse please do not listen to radicals. They may sound like they represent the masses but they do not. Not even close.
