Arsonist given long list of probation terms
A local man will spend two years on probation after being handed a suspended sentence by Chief Judge Heino Lilles on Friday for a charge of arson causing damage to property.
A local man will spend two years on probation after being handed a suspended sentence by Chief Judge Heino Lilles on Friday for a charge of arson causing damage to property.
Daniel Guy Lachance pleaded guilty in territorial court to a lesser charge of arson causing damage to property. He had initially been charged with disregard to human life where the arsonist knows or is reckless with whether there are people inside the property.
Court documents state Lachance intentionally or recklessly caused damage by fire to the house at 1303 Elm St. in Porter Creek around Dec. 17, 2005.
At the time, Whitehorse Fire Chief Clive Sparks estimated the fire caused about $50,000 worth of damage. Though not burned, the duplex suffered a lot of smoke and heat damage, he said.
The two-year probation term orders that Lachance cannot be within 100 metres of 1303 Elm St. and that he have no contact with a woman involved in the case. It's one of 16 terms Lachance must follow.
He also has to do 120 hours of community service in the first year with times and places directed by his probation officer.
Also in the first year of the order, Lachance must comply with a curfew of 9 p.m. to 6 a.m. each day unless he is with a responsible adult designated by the probation officer or with the prior written permission of his probation officer.
While on that curfew, he must also answer the phone or door between 9 p.m. or 6 a.m. when a peace officer or probation officer comes calling.
He must also:

Keep the peace and be of good behaviour, appearing before court when required and notify the court of any change in name or address. He also has to notify his probation officer of any change in employment;

Report immediately, and continuously, to a probation officer and in the manner directed by the probation officer;

Remain in the Yukon, except with prior written permission by his probation officer;

Attend psychiatric or psychological assessments, counselling, programming as directed by his probation officer;

Provide written consent to his probation officer to access information regarding assessments, treatment, counselling or programming Lachance is directed to;

Attend assessments, counselling, treatments or programming for alcohol and substance abuse which could include residential treatment as and when directed;

Abstain from possession, consumption or purchasing alcohol and non-prescribed drugs and submit to a breathalyzer test upon demand by a peace officer or probation officer;

Seek and maintain education or employment and provide his probation officer with written confirmation of it;

Live where directed by his probation officer, including the Yukon Adult Resource Centre, if directed. He also must adhere to the rules of the residence and not move without his probation officer's written permission;

Surrender any firearms licences, certificates or authorizations to the RCMP. Lachance can also have no firearms or explosives; and finally

He cannot go to a bar, tavern, off-sales or anywhere else where the primary purpose is to sell alcohol.
