‘Alicia Murphy has cut a hole in my soul’

It’s been almost eight years since the body of Evangeline Billy was found along the shore of the Yukon River in June 2008.

This morning in Yukon Supreme Court, 35-year-old Alicia Murphy pleaded guilty to manslaughter.

Murphy was originally convicted of second-degree murder and sentenced in 2009 to 14 years in prison without parole.

The conviction was overturned by the Yukon Court of Appeal in 2014 because of improper procedures, and a new trial was ordered.

The trial was scheduled for next month, when the unexpected plea was entered this morning.

Reading this morning from a joint submission prepared by the Crown and defence lawyers, Crown prosecutor Noel Sinclair recommended the court release Murphy from custody based on time already served, and impose a three-year probation order.

The joint submission called for a sentence of nine years in prison for manslaughter, but with credit for more than six years already served taken into account, Murphy should be released, Sinclair told Supreme Court Justice Leigh Gower.

Gower adjourned court shortly before noon to consider the sentencing submissions.

After reconvening court at approximately 12:30 this afternoon, Gower announced he was accepting the sentencing submission, resulting in Murphy’s release and a three-year probation order.

The court was packed this morning, mostly with members of the victim’s family and friends who had driven in from Carmacks to hear the guilty plea. They included Billy’s daughter, who was nine at the time of her mother’s death.

Reading from an agreed statement of facts, Sinclair told the court Murphy was on bail back in June 2008, accused of a violent domestic assault.

She was to keep the peace, abstain from alcohol and drugs, and stay out of bars.

Murphy had been partying with friends and was drunk and high on crack cocaine on the evening of June 21, 2008, the court heard this morning.

She left her friends shortly before midnight in search of more drugs and alcohol when she came across Billy along a trail beside the river, sometime between midnight and 5 a.m.

The Crown prosecutor told the court while Murphy was attempting to rob Billy of money and drugs, Billy suffered two substantial lacerations on the head.

Murphy then dragged Billy’s body to the river’s edge and pushed her head underwater. When she pulled her head back up, Billy was dead.

Sinclair said Murphy pulled down Billy’s pants and underwear in an attempt to disguise the crime, then pushed Billy’s body into the river.

Murphy joined her friends again to continue drinking and and smoking crack when later she told a couple of people she may have harmed Billy and done something to cover up the crime.

The RCMP arrested Murphy the next day.

An autopsy concluded the cause of death was drowning.

In making his sentencing submissions, Sinclair read from a couple of victim impact statements, including a statement from Billy’s daughter.

The daughter said she is afraid of Murphy; afraid that if she runs into Murphy, she will be hurt.

She has been robbed of her mother watching her graduate, and of her mother seeing her many accomplishments through life, the daughter said.

There will be no mother to help her plan her wedding; no mother to see her bear her children.

“When this is all over, I hope that for your children’s sake, you change your life around and give them what we will never get from our mother.”

Another of Billy’s children wrote: “Alicia Murphy has cut a hole in my soul that I fear will never be filled.”

And to top things off she has changed her name. This is absolutely wrong in every way. Justice in the Yukon is no where the same as other provinces.

Pretty sad case of injustice. Another classic case of Yukon courts. A complete joke. I wouldn't be surprised if she kills again. I couldn't imagine the pain and anger her victim's family and friends feel. Well I guess the only thing that will serve her now is Karma.

Don't be too taken back by the thumbs down folks, within a flick of an eye I saw thumbs down on a particular comment go from 2 to 64. I'm sure it is easy to manipulate an online voting system.

This is a absolute travesty of justice. This is not manslaughter...no accident...there was intent, thought, and intent to cover up the guilty act as a sexual assault. This woman is now walking the streets. She should have been convicted of 2nd degree murder and sentenced appropriately. Justice system took the easy way out and let her off with a M/S charge. F**cking joke.

I am surprised at the numbers of thumbs down.

Alicia Murphy murdered another woman. How can that merit a thumbs down? If anyone thinks less than 6 years is reasonable.. perhaps you can explain why?

I am at loss for words.This is a violent act, that took a life. Then even tried to cover it up. Psychopath. No remorse..
Not only did this individual take a life, but, took happiness of a little girl, took her mom, in a tragic way, traumatized a family.That can NEVER ever be undone.You take a life...Leave the planet.

What is it with our legal system (we have no justice system)!!!! if there was ever a clear cut case of murder this is it. Murphy admitted to holding Billy's head under the water until she drowned. It wasn't a case of her pushing Billy into the river and her drowning this way. That is manslaughter. This way was pure outright murder and should have been handled as such. So big deal it saved us the cost of a trial.
We have had no justice in this country since the constitution and bill of rights were enacted. When there is legislation to try to make criminals pay for their crimes trudope makes sure it is done away with. If you ever get into trouble be sure you are the offender and not the victim.

Under order as a condition of probation to abstain from alcohol because when she drinks she gets violent. So when she drinks it's just like packing a pistol before you leave home, showing intent to commit a violent act. Should be murder based on the drinking during probation.

Pretty sad when there are so many people voting down criticism of this cushy sentence. GET A LIFE. And remember that Alicia stole a life, very violently and needs to be punished and be dealt with for a very long time before she's allowed out in public. My uncle murdered my aunt and he was supposed to get out in 22 years...he's been in over 30, in the USA. I guess in the USA they take criminal sentencing a bit more serious...Yukon 'justice' is a joke, a big joke.

Watch out. This woman is a violent offender and extremely dangerous. Why should we have to live with this non-human in our community? She stole Evangaline's life and she NEEDS TO TAKE RESPONSIBILITY. If she was truly taking responsibility, she wouldn't be pleading guilty to manslaughter. Manslaughter is an accident--this is clearly second degree murder, no accident when you try to cover up what you've done and then drown the poor lady. DISGUSTING. You are a non human, Alicia. Hope you will be put away for a very long time to ROT.

I'm not one to judge but here is my opinion, wtf were you thinking??? This is one of the reasons why they've created missing and murdered woman in Canada! A recommendation should include Canada's failed justice system. Only in the Yukon does Shameful.

Wondering about 'Murdered and Missing Aboriginal Women'? Consider the ridiculous sentences given to some of their murderers, who also happen to also be Aboriginal in most cases. Read the RCMP report on it if you want the statistics on who is doing the killing.

I'm sure when Murphy first invented crystal meth and it's refining procedures she was a lot more under control:
oh wait, she didn't - she also didn't have a choice as to her socio-economic status at birth.
I'm always curious as to why people choose to use substances created by an oppressive group.

I am so disappointed in this turn of events. And guess where Murphy is from? The other community currently in the news regarding high crime - Carcross. Isn't that where Dean Johns was from? Disgusted.

Can't believe Judge Gower released her. Sad day for justice... But she is a headcase, so wouldn't be surprised if she messes up and lands back in a cell soon.
