The 38-year-old Whitehorse man was sentenced to just over three years in prison today, for barricading his ex-girlfriend and her three young children in their own home and terrorizing them with an axe.
In the early-morning hours of March 15, 2010, Surge showed up at his ex-girlfriend's home on Lewes Boulevard and attempted to hang himself from a tree in front of her apartment.
The woman's landlord called 911 and Surge was taken away by the RCMP but not kept in custody.
He returned at about 2:15 the next morning, this time armed with an axe. Before kicking in the woman's back door, Surge tied the front door handle to his vehicle so the family could not get out of the house.
A sharp-eyed neighbour noticed the rope, and knowing Surge had been harassing the woman the night before, realized the family needed help.
He cut the rope, but found the door locked and began shouting to the woman and her children that they could escape through the front door.
Inside, the woman had gotten her children into one of the bedrooms. Surge then blocked them in by pushing a cabinet in front of the door.
The neighbour could hear screaming inside the house as he waited for the police.
The RCMP arrived in a matter of minutes. Surge appeared at the upstairs window, saying he had a gun and that he wanted a negotiator to help him speak to his ex.
Eight minutes later, police broke through the front door, guns drawn, and found Surge inside with an axe in his hand. He dropped it when he saw the police and was arrested without further incident.
He was charged with a host of offences, including break-and-enter and aggravated assault, then added one more when he tried to escape from custody during a trip to Whitehorse General Hospital. He was caught on Long Lake Road within a few minutes of bolting from the back of the jail van.
In the aftermath of the attack, the victim told police Surge had said he wouldn't hurt her or the children and that he only wanted to talk.
For his part, Surge said he had come to get his bike back.
This standoff was not the first for Surge.
While living in Calgary in the late 1990s, he broke into the home of another ex-girlfriend's parent's in an attempt to steal a gun "to convince (the woman) not to have an abortion,” territorial court judge Michael Cozens recounted during today's sentencing hearing.
That incident resulted in a 14-hour standoff with Calgary police and a stay in federal prison.
In 1998 and again in 2001, the man was convicted of spousal assault and in 2007, he was convicted of criminally harassing his most recent victim.
In reviewing Surge's history, and his most recent psychological report, Cozens noted the man is at a very high risk to reoffend and appears to harbour a great deal of hostility toward women.
He consistently minimizes his own behaviour, the judge said, and puts some of the blame on the women he attacks. In this case, for instance, he said he went to the house because his ex-girlfriend wouldn't give him back his customized bicycle.
He also said he went there to kill himself, not harm the woman or her children, but as the judge pointed out, committing suicide in front of the family would cause "significant psychological harm.”
The judge's outlook on Surge's future as a peaceful member of society was grim. He noted that past jail and prison terms have done little to curb Surge's violent and abusive behaviour, nor have they persuaded him to take responsibility for his actions.
He sentenced the man to 46 months in prison, giving his credit for 7 1/2 months already served.
At the beginning of the hearing, Surge argued the whole case should be thrown out because it has taken so long to reach sentencing, claiming he has served more than seven months' "dead time” through no fault of his own.
Cozens dismissed that plea and said Surge could appeal the sentence.

James Ward is one sick twisted individual, I was dating his friend and that creep literally brought us to his place and put a blow up mattress at the end of that water bed, I slept on it then heard about what this freak did like 2 months later, You’d think you’d be able to smell it wouldn’t you????

I remember reading the papers about "James Ward Jr." The judge gave him such a light sentence because it was discovered that his dad used to 'choke him as a child'. My husband barely survived his childhood from being beaten by his step-dad. My husband couldn't hurt a fly. Jame Ward was a bad bad dude. End of story. Gross.

JAMES WARD JR. was the murderer's name...and he only got five years with most of it considered time served (you know with sitting in the Whse. jail it is time and a half off one's sentencing!). A get away driver for a robbery got more time than he did, they were in the news at the same time! If memory serves correctly James Ward has a few kids now too!

meh and chilkoot: His name isn't Mike. It's James Ward who killed and stuffed Miranda in his water bed. Miranda was a dear friend of mine. He got 4 years, served just over 2..... yes Surge should have gotten longer but when you have cases like Ward's case... Sounds like Surge got handed a harsh sentence. Something needs to be done to stop high risk offenders from being able to offend again. They shouldn't be allowed certain rights once declared a dangerous offender. Even though they served time in Prison, they should still have probation and conditions to follow. Shawn Surge will get out in less than 3 yrs and will have no conditions what so ever to follow. Off to do it again to the same family or another one.

Thank-You Meh!! I was trying to remember this guys name for the longest time. I remember it like it was yesterday..Such a tragic event. How much time did Mike Ward get? Miranda Peter's was so young and beautiful, and the scum bag stuffed her under a water bed for months without no one even knowing.

Just for the record yukon lady, woman's organizations normally do not get involved unless the victim request them to do so. I personally know this young woman and although my heart goes out to her big time. She is battling most of this in her own way. She has been offered the support and although she has taken some, she prefers to stay out of the limelight in many ways. She is intelligent and knows where to go to get the help she needs. it is places like Whitehorse Housing that we need to target to get policies changed for situations like this.

Funny I don't hear from the women's group that's NOT saying anything about this very violent act against this abuse woman. I thought they do not tolerate any domestic violence of any kind. Where are you Lorraine O'Brien? to defend this woman. I believe this man Surge should have given longer time in the PENITENTIARY. Come on women help me voice our opinion against this Surge and he was proven guilty. What a brutal act I say.

chilkoot...i believe his name is Mike Ward and said girl under the mattress was Miranda Peters. She was so young, and a sweet girl. He took away the only daughter her mother had left.

He should have gotten longer. The victim and her kids are still in the same home this happened in. They have been trying to get out but can't afford to move. She tried whitehorse housing even with a dr's letter stating because of her mental state, post traumatic stress, the triggers in her own home, she needs to get out. Whitehorse housing denied her because She got a security dog after the attack. But if she takes a knife and makes herself blind and teaches her security dog to be her seeing eye dog also, They will accept her. Pathetic.

Shawn Surge will get counseling, three square meals a day, exercise, probably even a television and access to educational programs. The little family he terrorized still has to go to work, go to school, pay the bills, cope with their fears and the deep psychological wounds Mr. Surge has inflicted. There will be precious few resources offered to them, if any. He will have his freedom long before they have shed their fears.
Kudos to the neighbour who took the risk and reached out to help this little family. Too bad we can't tattoo "Loser" on Mr. Surge's forehead to warn other women before he gets loose and repeats his horror on another family. My sympathies to this woman and her children.

He was arrested the first time and not taken into custody, so he shows up the next day with an axe.

Three years and back within 18 months. The (in)Justice system won't be happy until he gets his pound of flesh from an innocent victim. Then, another committee will be set up to find out what went wrong with the system. Same old, same old.
