Restaurant’s liquor licence suspended until April 22

Earls Kitchen + Bar has had its liquor licence suspended for nine days for various violations of the territory’s liquor laws.

Earls Kitchen + Bar has had its liquor licence suspended for nine days for various violations of the territory’s liquor laws.

Those include serving alcohol to minors, allowing disorderly conduct and obstructing inspectors.

The majority of the breaches occurred during an after-hours staff party in early March where underage employees were allegedly consuming alcohol.

Earls had shut down from 7 p.m. to 2 a.m. for the private function, and a liquor inspector driving by decided to investigate.

He observed violations of the Liquor Act and its regulations, Yukon Liquor Corp. spokesman Doug Caldwell said today.

He could not say what time this occurred nor what prompted the inspector to investigate.

Earls’ majority owner, Rich Thompson, learned of the incident five days later, when one of the restaurant’s competitors told him Earls employees were discussing the party.

Thompson wasn’t impressed.

“To say that I was upset is an understatement,” he said in an interview today.

“I expressed complete dissatisfaction about the fact that we were using our premises for a staff party and that there was any chance that we would be operating an event where underage people could be served liquor.”

As the inspector continued to investigate, management’s answers to his questions were not truthful nor complete, Caldwell said, which led to the cited obstruction.

“There will never be another staff party held at Earls again,” Thompson said.

“This is an extremely serious thing, to be accused of serving minors.”

He acknowledged the “fairly severe financial penalty” the suspension will have on Earls, but said he completely agrees with the punishment.

A full review of staff policies and procedures has been conducted, with a zero-tolerance policy implemented for the employees who organized the party, Thompson said.

If they engage in similar behaviour in the future, they will be dismissed immediately.

“They fully recognize the mistake that was made here,” he said.

As an apology to customers, Thompson said Earls will offer free pop, coffee and juice until the suspension ends at 10 a.m. April 22.

The restaurant’s signature non-alcoholic drinks will be 50 per cent off.

Earls will also donate $1 from every bill to MADD Whitehorse, he said, “so that some good comes out of this.”

Caldwell said Earls employees purchased alcohol for the party under the restaurant’s licence when they should have applied for a reception permit, which is specifically for private events.

Regardless of the type of licence or permit, serving alcohol to minors is illegal.

A yellow notice posted on the Whitehorse restaurant’s front door notes the eight breaches:

• Permitting disorderly conduct;

• Obstructing liquor inspectors (two counts);

• Possession or consumption of alcohol by a minor;

• Providing liquor to a minor;

• Failure to demand proof of ID/supplying liquor to a minor;

• Serving liquor to a disorderly person;

• Failing to maintain order; and

• Breaching the act or its regulations.

The licence was suspended Monday.

Caldwell said this duration is considered a severe penalty.

Suspensions can range from one day to a bar or restaurant losing its licence completely.

I believe that the manager in question is also a partial owner and would explain the lack of firing. Also it's semi common knowledge. That this type of behavior has been common place

@not surprised. It's not cool to post things about someone re: things you've "heard from staff" or even your opinions. If you didn't like what you heard, then perhaps calling Earls Head office would have been the best idea. To post comments about someone who you have never spoken to is cowardly and plain low. And no, I don't know any of the management or anyone who works there.

Not surprised at all to hear this, what did anyone think would happen with the kind of management they have in place there?! I'm surprised they haven't been caught sooner ... it's a steady stream of unprofessional, illegal behavior out of there - how does the manager still have a job? I've heard an awful lot of disturbing things about him from the staff there, this being the least of it! If this kind of thing is tolerated, which it appears to be by the fact that no one has lost their jobs, I don't imagine Earls will be around much longer ....

Mistakes were made and the owner has taken responsibility. Case closed.
@PSG is correct, there are more serious substance abuse issues in this town that should get more attention.

People having fun without a licence and minors being served a few drinks is something we definitely do not want to see but meanwhile, on the gritty streets of Whitehorse, any of us can easily go out and score as much crack cocaine and meth as we can afford. Shouldn't stopping that be more of a priority?

They probably should have seen this coming and made arrangements to avoid minors using the alcohol available to them at the restaurant. If you put a bunch of teenagers in the same room as the booze and close the place down for their party, what the hell did you think would happen? No manager was there?

One of the old folks homes here used to take some of the old lads down to the Capital at rendezvous to watch the "shows". Some moral citizen caught wind of it and had it shut down as it was immoral. True story.

Mr. Thompson, I admire your response to this incident. You are doing the right thing, your business is taking responsibility for the breach and you are upfront. Giving money to MADD is also very respectful. I wish more people and businesses would be honest and upstanding like you. You have my respect.

Pffft like this is the first time this happened at Earls. I know of several parties they've had there.
At least you didn't catch the people with their pants down this night. Or the 2 guys and 1 girl canoodling in the walk in cooler.

Well done Mr. Thompson. You have demonstrated responsibility for the situation as is right. But to go beyond the government issued penalty and donate to MADD; I hope will serve as a model for your fellow bar owners to how the booze industry can make a positive contribution to the problems our communities have with liquor.
