“An ongoing assault” is how Michael Nehass’s lawyer characterizes his experience at Whitehorse Correctional Centre (WCC).

Defence lawyer Anik Morrow said that’s one of the reasons she wants her client moved to Ontario Shores, a mental health centre near Toronto.

Morrow outlined her position in Yukon Supreme Court this morning, where Crown prosecutor Eric Marcoux put forward an application for an assessment to determine whether Nehass is “fit to stand trial”.

Nehass has been detained at the WCC since 2011, when he was charged with forcible confinement, assault with a weapon, breaching probation, and uttering threats.

In May 2015, a jury found him guilty of all but the latter charge. Since then, he has been in jail awaiting sentencing, which has been delayed for various reasons.

One of these includes the Crown seeking to have Nehass declared a dangerous offender (Nehass has been convicted of multiple aggravated assaults, including cutting off a man’s fingers with a meat cleaver).

This finding would impact sentencing.

Before this designation can be considered though, Nehass must undergo psychiatric assessment.

Richard Fowler, acting as amicus or friend of the court today to assist the judge, said he believed reports from 2014 found Nehass unfit to stand trial.

Fowler said those reports called Nehass “paranoid” and said he suffered from “grandiose delusions”.

Fowler said recent phone messages from Nehass suggest the same disturbed thoughts and “flight of ideas” referenced in the 2014 reports.

Nehass sat quietly at the counsel table while Morrow mentioned the same reports.

She said that, since 2011, Nehass has spent extended periods in solitary confinement (in 2014, his father filed a complaint with the Yukon Human Rights Commission, alleging overuse of segregation).

Morrow cited the opinions of multiple doctors and staff inside and outside the WCC.

Reading from reports and testimony, Morrow told Justice Scott Booker there had been widespread agreement over the years that the effects of segregation were contributing to the deterioration of Nehass’s mental health.

In 2014, the WCC stated that Nehass had outstripped its resources.

This, Morrow said, has left Nehass “twisting in the wind”.

She said it was the professional opinion of more than one doctor that unless Nehass was removed from the WCC, his condition would not improve.

Morrow then asked that Booker consider Ontario Shores as an option for assessment.

Marcoux said he is open to Morrow’s suggestion of an assessment being done outside of the WCC.

Court was adjourned until Wednesday at 1 p.m., when Phillip Klassen, director of Ontario Shores, will videoconference in to discuss the assistance offered by the centre.

He should have been sent out for assessment years ago. He is obviously in need of help that our small WCC is not set up to provide or should the employees have to put up with such abuse.
Send him to a place that can figure out what his problem is.

I've worked in the system for years. I worked at wcc years ago when Mike started coming to jail.
Ummm where do I start -
Assaulting after assaulting. It never ended..
Fire after fire set.
Tied up an inmate with shredded sheets.
Escape attempts.

Hidden pins under his skin in hopes to opening his cuffs.

Tried escapes from hospital, Staff assaults, Inmate assaults.
Broke ceilings walls, cell bars, trays thrown, weapons made, threats to kill
The stares of I'll kill u.

Smashed TV after TV, slit his wrists to get escorts out, threats to nurses.
How do u deal with that day after day - never ending danger ???

When violence wasn't working it was sexual talk.
When that didn't work, back to violence in seconds.
Even the toughest of inmates were scared of him stating " he's fn crazy " keep him locked up
Throwing s**it and piss on staff. Hiding and jumping out at staff.
I'm a caring kind person - I have a special needs son who has in his early years done not so good things.
I want help for everyone.
I'm first nations.
I really believe with all my heart Mr. Nehass needs to be locked up.... sad ....... Yes........ However he is severely extremely dangerous.
Nobody really understands what it's like first to work in a jail, but to deal with this every single day.

Yes, it's part of the job
But...... not from one guy everyday.
I can also honestly say the staff treated him very very good. Were fair to him, making sure he had fresh air. Clean clothes daily,
lots of food.

He was not once mistreated when I was there. I was there for several years In fact. He was given extras in hopes at times to settle him down

This is very sad
Have Ontario deal with him.

Oh, god bless society today. Everyone has a "disorder", thanks to those writing the prescriptions, and it is always someone else's fault isn't it...never the person who holds the cards for their own life and how they act and behave towards others.
Always the fault of society...never the individual.
Somehow the guilty always become the "victim". Give me a break.

Yes he clearly did not have any mental or violent issues prior to incarceration, certainly not when he chopped off someone's fingers with a meat cleaver....
Hard to have someone in general population when they threaten everyone's safety and smash everything in sight.

To people who claim this has something to do with race...if it was a Caucasian, Asian, AA, or native...if you are violent you are probably going to be separated from others and treated differently. If you continually smash things you are given you will probably cease to be given things.
It's pretty simple...don't want to be in solitary? Act accordingly. I think he has expired his benefit of the doubt card.
I'd say it more likely that he wants the attention...he loves and revels in the fact that everyone is "scared" of him...that he is now infamous in the Yukon.

he never had mental health issues before he went to jail, the jail did this to him, he needs help we all know this, they should have helped him yrs ago instead of keeping him in solitary confinement.

You don't have a clue how the man (I don't condone what he has done to other people) has gotten to where he is in life, not a clue. It seems if it is a FN person they are open game on this site. When it is a non FN person, not a peep, interesting how that happens.

I agree with DJ, Ray when you worked at WCC you signed an oath of confidentiality, why would you break that after the fact. Very inappropriate to comment on an individual when you were in a position of trust.

Everybody is holding back except for the snowflake Michael. He has chopped off someone's fingers, smashed in someone's face, beat up a woman and threatened to kill her, and I am not aware of what else other than his destruction of property (ripping a phone out of the wall, setting a room on fire, etc). These are just what I remember from news stories.

If anyone was actually allowed to respond in the way Michael does every chance he gets, he would no longer be in a position to pose a problem. We are more civilized than he is though, so we get to try to keep him safe and treat him well. When Michael Nehass continues to be himself, we as a society we are blamed with our failure to cure him of his tantrums and violence, while being criticized that his accommodations are not up to standard.

Zoos manage to keep gorillas in very pleasant surroundings. Michael hasn't one tenth the strength of a gorilla. Can we not build him an enclosure where he can live out his natural life? And don't give me any sob story about his need for company unless that company is capable of, and allowed to respond with whatever force necessary to protect itself completely from Michael's perpetual violence. A nice little habitat with food provided daily would be probably the nicest thing we could do for him, not that I think he deserves it. But let's be realistic and stop wasting money on assessments and court dates and trips across the country. This is getting ridiculous.

At this point I don't care in the slightest what is wrong with him. He does not belong loose in society. We have been told we are responsible for his meals, clothes, heat, shelter and safety... fine. Just build an enclosure and be done with it. The situation is obvious. He is one of those few who should never be loose, and who 'we' cannot fix.

Why are you talking about specifics of prisoners actions, etc., while you were employed at the wcc? Kinda thought that was frowned upon even after you retire....seems inappropriate for you to be commenting like that. (Not sticking up for this pos either though...no doubt you are right...just sayin)

Send him to Ontario or whatever, just as long as he can never come back to the Yukon, regardless of the excuses they make for his unacceptable violent behavior.

Bring the professional from Ontario Shores to the Yukon to assess him, he does not deserve to be sent out, waste of taxpayers money. Sounds like he does not want the help, what difference is it going to make sending him outside? He needs to be held accountable for his actions.
That's the problem now a days, he has no one to blame but himself. There are a lot of people with mental illness that would like the help focus on the ones that want help. Special treatment, because why??????

I retired from WCC in 2008, one of my duties was being responsible for maintenance of the facility. I dealt with Michael's trail of damage to the facility for years. Michael has stages of anger, serious anger and is very dangerous. Be careful when dealing with him.

I agree.. send him to anywhere that there is help available and professionals that can deal with criminally ill, violent persons. And leave him there. Not today, or any day will the Yukon be able to successfully help this individual. If he does improve in Ontario, bringing him back to the Yukon will only assist him to lose ground.. old familiar haunts, old familiar behavior. And, there still won't be the help here that he needs.

Michael scares me. I hope that Northern Shores can offer some treatment for his mental health issues, for his sake and ours.
