Charges laid after double-fatality collision

RCMP have laid criminal charges against a teenaged girl

RCMP have laid criminal charges against a teenaged girl who was behind the wheel of a car when it collided with a semi truck on the Alaska Highway last August, killing two passengers.

The driver faces two counts of criminal negligence causing death and one count of criminal negligence causing bodily harm.

She is scheduled to appear in youth court at a later date, Whitehorse RCMP Insp. Archie Thompson stated in a release issued late this morning.

The driver’s name cannot be released, as she is under 18 years of age.

The early-morning collision occurred on the Alaska Highway at the Hamilton Boulevard extension on Aug. 9, 2014.

It left a 15-year-old girl and a 20-year-old man dead.

Clare Cherepak, a student at Vanier Catholic Secondary School, and Brendan Kinney, a graduate of Porter Creek Secondary School, were passengers in the 3 a.m. accident.

Kinney, who was sitting in the front passenger’s seat, was found dead at the scene by emergency responders. Cherepak died in hospital.

An 18-year-old male passenger, Derrick Gibbons, was medevaced to Vancouver General Hospital in serious but stable condition. He spent weeks in hospital.

The 15-year-old driver was treated and released the same day.

The truck driver was not injured.

Whitehorse RCMP Const. Christine Grant said shortly after the incident it was not yet clear what had happened, but it seemed the car, a compact Honda Accord, was travelling north when it turned in the intersection into the path of the oncoming truck.

“That’s what I understand happened,” Grant said.

The Whitehorse RCMP traffic analyst was on the scene to investigate, she noted.

Assistance from the Whitehorse Fire Department was needed to remove the occupants from the car, due to the extensive damage.

“It is with deep sadness that we mourn the sudden and tragic loss of one of our students,” Vanier principal Ryan Sikkes wrote in a statement posted on the school’s website at the time.

“(Clare’s) smile, warmth and humour will be missed by staff and students alike.”

Cherepak would have started Grade 11 last September.

In an article for What’s Up Yukon posted online last winter, she wrote that she played guitar, bass guitar and drums in one of Vanier’s rock bands.

The year prior, as a member of the school’s Social Justice Club, Cherepak walked up and down Main Street in the snow collecting change for UNICEF.

Rea Postoloski spoke to the Star after Cherepak’s death – she first met the girl in a Kindergarten class at St. Elias Community School in Haines Junction.

Postoloski was an educational assistant then, but after she became a teacher, she did her four-month practicum in Cherepak’s Grade 6 class.

“She was an awesome kid,” Postoloski told the Star last August. “She was bright, helpful, kind, considerate. Just a really nice kid.”

She said the Cherepak family later moved to Whitehorse, and she ran into them around town, at sporting and community events.

“She loved sports,” Postoloski said. “She was very outdoorsy.

“Her mom and dad were awesome at always making sure she was very involved in environmental issues, and things like that. She certainly was on her way to becoming a steward.

“She was a wonderful young lady.”

Kinney worked at Bigway Foods in Copper Ridge. He was a graduate of Porter Creek Secondary School.

Store manager Ash Jurovich told the Star he had hired Kinney three years earlier, when Kinney was still in high school. He’d been working at the store full-time since graduating.

Kinney was one of the more senior staff – he would assist customers, run the till, stock shelves and work in the bakery.

“He could do everything around here,” Jurovich said.

“He was really outgoing, really funny. He was a smart kid. He got along great with everybody. Just one of the best guys I knew.”

Memorial pages for both Cherepak and Kinney were created on Facebook in the wake of the collision.

My sister was in the same accident 2 years ago and the man driving didn't get charged. He was 18 and he crossed the center line. Why is there no charges being laid against him when clearly he went over the center line, huh.?

After reading this article I do not see any mention of alcohol nor drugs, why are people assuming such is the case. The young lady driving was only 15 years young and possibly had not been driving too much and possibly the reason for the accident. Yes, I agree that charges be laid, we all have to be held accountable for our actions. I also question why a 15 year young girl was out at 3 am in the morning?
My heartfelt sympathies go out to the family and friends of those taken so young and so tragically. I also wonder how that poor truck driver must be dealing with such an awful accident of which he was at the wrong place and the wrong time. May good bless him and hope he finds peace. Most knowledgeable and experienced drivers had a pretty good idea of what happened to cause the collision. The fact that it's taken seven months to lay charges, leads the public to question the impartiality of the justice system. Especially in cases where laws have clearly been broken and people killed.

It is good to see charges laid. Yes, people make mistakes when they are young. But people need to be held accountable if those mistakes result in the deaths of others. Of course, I feel terrible about the deceased and their families. But impaired driving, negligence driving or whatever is a concern - at a minimum, the driver was not licenced to drive at that time and should not have been driving. The driver could have killed others - I drove by the scene at 6 am and it was chilling and obvious what happened. This case is about specific and general deterrence and hopefully a bit of healing. I have been concerned that it has taken six months to lay the charges.

This is a tragic event. I wish people would stop pushing judgment on the kids. Enough is enough. Everyone has suffered in some way, while others have lost their lives.
There is no proof of drinking, no mention of driving intoxicated, no mention of anything alcohol related, so I am just wondering why everyone is passing judgment on the victims of this truly tragic accident.

No one was there but them. It was a long process to finalize the charges as it was a long process to piece together the post and pre-accident details. So, before anyone throws a stone, maybe step back and realize there are hurting families here.

The charges, in my opinion, are necessary and just.

hmmm...sure took a very long time to press those charges?
I guess the Y.O. has important parents?
So the driver was not impaired, no alcohol...as I did not see those charges?
Given the nature of our Y.O.A., the Y.O. will be well protected from any consequences in both the law courts and the court of public opinion.
...opinions we are all free to express regardless of the sensitive nature of said topic.

Sad and tragic on Mar 8, 2015 at 12:21 am

This is horrible, sad for everybody involved. Why was the 15 year old driving? My speculation would be that the owner of the car wasn't in a sober condition to drive, so she was put in the drivers seat. Blaming the 15 year old driver isn't totally fair. Yes, she needs to be charged--people are dead and one person has injuries that will last his lifetime. The reality is, a parent should have been called to pick all of these kids up. The boy who owned the car could have just as easily been driving, wasted. He only got his car, ironically, a few days before this tragedy. Yukon needs to change its party culture--why is drinking and getting high so valued up here? Biggest sympathies for the kids who died and the male who survived and all of your loved ones.

All of you so called people known as mankind are not acting or thinking right.. none of you know what truly happened in that car or the events leading up to all 4 of them piling into the car. Until you have lived through something similar, until you walk a mile in that position, all of you should just stop passing judgement on what you don't truly understand.

This was a very sad situation. My heart breaks for the two young people (and their families) who lost their lives that morning and the young man who was so seriously injured. I hope that he will have a full recovery. The young girl who was driving will have to live with this memory for the rest of her life but she also needs to be accountable for driving with no licence. 15 years old is too young to be out at 3 am. Also there is another person who will be haunted for the rest of his life (the truckdriver), can you imagine what he must have felt when he got out of his truck to see this horrible scene. I am sure it is not something he will soon forget....if ever. I pray for all involved, may you all find peace in your hearts.

Tom Stephens, how do you explain the naming of the 15 y.o. deceased but not the naming of the 15 y.o. driver? Does YCJA only protect some youth, like those that are connected?

Well I must say all 4 people made a HUGE mistake that night to get into that car and cruise around BUT I feel the blame is ALL on that 15 year-old driver because she was 100% the one in care of all of them inside that car!!

If there is such a thing as a silver lining perhaps this accident will prevent similar ones from taking place in the future.
The charges may have something to do with liability and insurance claims.

We should consider that all of the young people involved in this accident were friends and in the car together- and so with all the sadness all share some responsibility for this tragic accident.
I hope the driver is able to move on with her life and that people support her and make it clear that this was an accident.

Although I don't disagree that this girl has been through enough, I think there would be more of an uproar if no charges were laid. Yes, what happened is awful and an accident, however, she did break the law.

It's just an awful situation all together. Hopefully a lesson for not just her but for ALL young people who think "it'll never happen to me". Sometimes you don't get caught, sometimes you pay a really awful price.

The reason the 15 year old accused is not named is because the YCJA prevents it..has nothing to do with anyone being protected...

It was certainly a tragic event. It is however, interesting to note that they named the 15 year old deceased but not the under 18 year old driver. Why is that? Is someone being protected?

So tragic. My heart goes out to the families that lost their children and also to this young girl whose life is forever changed. I can't imagine how horrible she must have felt knowing she was responsible for the deaths of two of her friends and now to have to relive it all again. Obviously she shouldn't have been driving, but I still feel so sorry for her knowing what she has to live with for the rest of her life. My heart goes out to you, too, little girl.

Keep in mind that all the young adults involved, both deceased and otherwise, were probably great kids, full of hope and promise before this tragedy. This is just so, so sad all the way around. I'm sure the RCMP have to do what they have to do, but I'm trying really hard to see what good laying criminal charges will do to bring closure and something positive out of this.

I do not see how criminal charges will help anyone in this situation. This girl will live with the consequences of her actions for the rest of her life.

On the other hand, I realize that the RCMP would have laid charges immediately, and a longer list of charges, had the driver been a male. Sad, but true.

I am not blaming the Star however does it make any sense that all of the victims and injured are named while the perpetrator is not. Even the under aged deceased is named. What are young people doing out at that time of day and were drugs and alcohol involved? Why was a 15 year old driving? I feel terrible for the Truck Driver.

As parents, we try to teach our children responsibility and over and over again we lecture safety and to never drink or drive or be in a car with someone drinking. We cannot be everywhere our children are. It is really sad all around.
Look at any bar in Whitehorse at the beginning of the night and at the end. Most of parking lots are empty and you cannot tell me that everyone brought a sober driver. It happens all the time. Yukon has a culture of drinking and it does not matter who you are.

This is just a sad story all the way around. I mean two young people lost their lives. Now another is about to face all these charges and potentially go to jail destroying their future. Parents really need to be more aware of what and where there children are....I know that's tough, just a sad story overall and my heart goes out to everyone involved.
