Tenant ousted under SCAN law

Investigators with the Safer Communities and Neighbourhoods (SCAN) unit of the Department of Justice have served a tenant in the downtown core with a five-day eviction notice.

Investigators with the Safer Communities and Neighbourhoods (SCAN) unit of the Department of Justice have served a tenant in the downtown core with a five-day eviction notice.

The tenant, who is not named, was served last Wednesday following a comprehensive investigation, said a government press release issued Friday.

"The investigation concluded that the tenant was engaged in habitual illegal activity from his residence and that these activities had an adverse effect on the community.”

Evidence from the investigation includes close to 150 visits to the residence, many of which were suspicious in nature and consistent with the illegal sale of controlled substances.

"Of particular concern were the high numbers of youth attending the residence for short periods of time exhibiting behaviours consistent with purchasing drugs from the tenant.”

Several members of the community complained about the high volume of traffic to the residence at all hours of the night, disturbances, persons leaving the property in an intoxicated state and noise emanating from the property.

Community members also expressed concern about the number of youth coming and going from the residence and the harm which could come to them.

The RCMP conducted a search on the residence in question and a number of charges have been laid against the tenant including trafficking and possession for the purpose of trafficking under the Controlled Drugs and Substance Act.

He has been remanded into custody.

In May, suspicions of bootlegging prompted the Yukon government to seek a court order evicting a Porter Creek homeowner from his house for 90 days under the SCAN legislation.

If successful, it would be the first such action against a homeowner, though evictions of rental tenants are more common.

A court appearance for the homeowner, Marius Moustakas of 1312 Centennial St., is scheduled for July.

SCAN has received close to 500 complaints since the inception of the act in 2006.
