Charges dropped against man allegedly assaulted by RCMP

Criminal charges laid against the man allegedly assaulted by a Carcross RCMP officer earlier this month have been dropped.

Criminal charges laid against the man allegedly assaulted by a Carcross RCMP officer earlier this month have been dropped.

Duke Beattie, 34, of Carcross, faced five charges in connection with the May 15 incident, including two breaches of his probation.

The other three charges – threatening to cause bodily harm to two RCMP officers and resisting arrest – have been withdrawn by the Crown, according to court records.

The Crown prosecutor on the case was not available this morning to comment on why this happened.

One of the RCMP officers who interacted with Beattie the night of May 15 is under investigation for allegedly assaulting and threatening him in the back of the police vehicle, after he was arrested.

The officer has been on scheduled time off from work since the incident. No charges have been laid against him, said Staff Sgt. Brad Kaeding today.

For this reason, the Star is not naming him.

Yukon RCMP Major Crimes Unit said Monday it was “deeply troubled” by the allegations, and has completed an investigation of the officer’s actions.

It’s been passed along to the Alberta Serious Incident Response Team for review.

RCMP are not disclosing the nature or seriousness of the alleged assault and threats.

Whitehorse General Hospital spokesman James Low said this morning Beattie was at the hospital sometime around May 15, but was not admitted as a patient.

That means he accessed out-patient services, which may have included the emergency room or specialist clinic.

Citing patient confidentiality, Low would not say which services the man accessed.

According to court documents, the dropped charges alleged Beattie didn’t follow the officers’ verbal commands, pulled away from them and was assaultive toward Whitehorse jail guards.

He’s now charged solely with breaching his probation order by drinking alcohol and not keeping the peace. He has been released on bail.
